Subject: Ratification of Agreements in Response to COVID-19 Pandemic

Adopt a resolution ratifying certain agreements relating to the procurement of goods and services in connection with the County’s response to the novel coronavirus (COVID-19) local emergency.

BACKGROUND:
In January 2020, the United States confirmed its first case of COVID-19 in Washington State. As of March 31, 2020, the Centers for Disease Control and Prevention have reported 163,539 confirmed cases of COVID-19 within the United States resulting in 2,860 deaths. As of March 31, 2020, there were 388 confirmed cases of COVID-19 within San Mateo County resulting in 10 deaths.
On March 2, 2020, the County of San Mateo’s Emergency Operations Center (EOC) was engaged to assist in coordinating and disseminating public information regarding COVID-19. On March 3, 2020, the County’s Health Officer issued a “Declaration of Local Health Emergency Regarding Novel Coronavirus 2019” and the County Manager, as the County’s Director of Emergency Services (the “Director”), issued a proclamation of local emergency pursuant to Government Code section 8630 and Chapter 2.46 of the County’s Ordinance Code, which proclamation was ratified by the Board of Supervisors on March 10, 2020, pursuant to Government Code section 8630 (the “COVID-19 Local Emergency”).
On March 16, 2020, six Bay Area Health Officers (from the counties of Alameda, Contra Costa, Marin, San Francisco, and San Mateo, and Santa Clara) issued orders directing their respective residents to shelter in place for three weeks beginning March 17, 2020. On March 31st, those shelter in place orders were updated and extended through May 3, 2020.
DISCUSSION:
For the immediate preservation of order and of public health, the Director and the Director’s designee (the EOC Incident Commanders), made many requests for services, supplies, and equipment upon the declaration of local emergency on March 3, 2020. Thereafter, certain of those expenses were being made through County Department appropriations.
At its March 24, 2020, meeting, the Board approved an Appropriations Transfer Request in the amount of $15,000,000 from Non-Departmental Reserves to funds directly related to the EOC so that future agreements could be streamlined to a single budget unit that could be more easily traced for reimbursement purposes at the Federal level. The Board also adopted Resolution No. 077305which authorized the County Manager, as the County’s purchasing agent and Director of Emergency Services, or the County Manager’s designee, to engage independent contractors to perform services related to the COVID-19 Local Emergency for the County up to and including $500,000. Resolution No. 077305also authorized and directed payment in connection with any agreements executed by the Director, or the Director’s designee, from the issuance of the proclamation of local emergency (March 3, 2020) prior to the date of the resolution provided that this Board ratifies such agreements within thirty days of the agreements’ execution.
Attachment A to the resolution accompanying this Memo sets forth all of the agreements authorized by the Director of the EOC Incident Commanders as the Director’s designee, during the period from March 3, 2020, through March 23, 2020, for which ratification of the Board is requested pursuant to Resolution No. 077305.
The resolution has been reviewed and approved by County Counsel as to form.
FISCAL IMPACT:
The nine agreements included herein together have a total not-to-exceed amount of $23,274,611. These agreements will be funded through the previously-approved $15,000,000 ATR and through a forthcoming ATR to provide additional funds for the EOC through the end of the current fiscal year.
