BACKGROUND:

Founded in 2013, the Bay Area Regional Energy Network (BayREN) is administered by the Association of Bay Area Governments (ABAG) with funding from the California utility ratepayers under the auspices of the California Public Utilities Commission (CPUC). BayREN is a collaboration of the nine San Francisco Bay Area counties implementing energy efficiency and electrification programs on a regional level.

 

BayREN currently offers six subprograms throughout the Bay Area: Single Family Residential, Multifamily Residential, Codes and Standards, Commercial Sector, Water/Energy Nexus, and Green Labeling. Through BayREN, Bay Area residents, businesses, and local governments have access to an array of incentives, technical assistance, resources, and financing options to assist them in completing residential, commercial, and public sector energy upgrades.

 

Each calendar year, ABAG contracts with the nine Bay Area counties to provide local marketing, technical support, and outreach activities to promote BayREN offerings in their local community. Since the first program cycle in 2013, ABAG has contracted with the County to implement BayREN activities in San Mateo County, administered by the Office of Sustainability (OOS).

 

On March 24, 2020, this Board adopted Resolution No. 077308 authorizing the existing agreement for the County to receive revenues of up to $637,383 from ABAG to fund local outreach support for BayREN programs in San Mateo County from January 1, 2020, through December 31, 2022.

 

On March 9, 2021, this Board adopted Resolution No. 078050 authorizing an amendment to this agreement increasing the agreement amount by $50,500 to an amount not to exceed $687,883 to support additional work in the Single-Family Residential and Codes and Standards sub-programs.

 

On December 13, 2022, this Board adopted Resolution No. 079390 authorizing an amendment to this agreement increasing the agreement amount by $315,461 to an amount not to exceed $1,003,344 and extend the end date of the contract from December 31, 2022, to December 31, 2023, to support the continuation of the current portfolio of programs.

 

OOS is reimbursed by ABAG for staff time and expenses incurred to implement BayREN activities.

 

DISCUSSION:

For calendar years 2024 through 2027, ABAG is contracting with counties to implement BayREN programs for a four-year period. For the term of January 1, 2024 to December 31, 2027, ABAG is contracting with the County for a not to exceed amount of $1,278,957. The County will be reimbursed on an ongoing basis as it submits invoices to ABAG.

 

Beginning in 2024, BayREN is adding four new subprograms to its portfolio: Workforce Education & Training, an additional Commercial Sector program, and two Public Sector programs. OOS will implement BayREN activities for these new subprograms as well as the original six subprograms.

 

The County Attorney’s Office has reviewed and approved the agreement and resolution as to form.

 

FISCAL IMPACT:

The term of the agreement will be from January 1, 2024, to December 31, 2027. The amount of the agreement is not to exceed $1,278,957 from ABAG for OOS to implement the BayREN programs. Funds in the amount of $168,048 will be added to the OOS FY 2023-24 Adopted Budget, $341,830 will be added to the OOS FY 2024-25 Recommended Budget, $321,353 will be added to the OOS FY 2025-26 Recommended Budget, $297,648 will be added to the OOS FY 2026-27 Recommended Budget, and $150,078 will be added to the 2027-28 Recommended Budget. There is no new Net County Cost associated with the agreement.
