BACKGROUND:

On February 26, 2002, the Board adopted Ordinance No. 04099, codified at Chapter 4.105 of the San Mateo County Ordinance Code, designed to increase the salvage, reuse, recycling, and diversion of construction and demolition debris from projects within the unincorporated areas of San Mateo County. The Ordinance mandated that as part of the building permit process, new construction, remodels, and demolition projects must include a waste management plan outlining the strategies that will be used to meet a minimum level of diversion from landfill of the resulting construction and demolition debris through salvaging, reusing, or recycling.

 

On December 13, 2016, the County incorporated this requirement into Sections 9213-9217 of the Building Regulations. This step was taken to streamline the building permit process by centralizing all relevant requirements into the Building Regulations.

 

DISCUSSION:

When the waste management plan submission and approval requirement was incorporated into the Building Regulations on December 13th, 2016, the language from Chapter 4.105 was not removed. As a result, the waste management plan requirement currently exists in both Chapter 4.105 of the San Mateo County Ordinance Code and in the Building Regulations. Repealing Chapter 4.105 will increase clarity in the law by having all the requirements for new construction, remodels and demolition waste management plans located in one section of the Building Regulations.

 

County Attorney has reviewed and approved the proposed ordinance as to form. 

 

FISCAL IMPACT:

There is no Net County Cost associated with the adoption of this ordinance.
