BACKGROUND:

Environmental Health Services’ (EHS) Household Hazardous Waste (HHW) program was formally established in 1992 after the passage of AB 939, the California Integrated Waste Management Act. This State law requires local jurisdictions, such as the County, to manage HHW programs to allow residents, small businesses, and municipalities to safely reduce, reuse, recycle, and/or dispose of residential hazardous wastes.

 

In operating its HHW program, EHS contracts with vendors to provide additional labor, equipment, supplies, transportation, and hazardous waste disposal services to support the collection of HHW. In May 2023, EHS conducted a Request for Proposals (RFP) to provide these HHW-related services. EHS selected a provider, Advanced Chemical Transport, Inc. dba ACTenviro (ACTenviro), based on its ability to provide services, qualifications, and competitive pricing.

 

DISCUSSION:

ACTenviro will support the HHW program’s operational needs by supplying the program with 1) supplies related to hazardous waste collection and storage; 2) personnel to assist in operating multiple HHW collection events throughout the County; 3) hazardous waste transportation and disposal services; and 4) data tracking.

 

The resolution contains the County’s standard provisions allowing amendment of the County’s fiscal obligations by a maximum of $25,000 (in aggregate).

 

The County Attorney has reviewed and approved the resolution and agreement as to form.

 

It is anticipated that 750,000 pounds of HHW will be collected and diverted from illegal land and water disposal.

FISCAL IMPACT:

The term of the agreement is October 4, 2023, through October 4, 2026. The total amount of the agreement is not to exceed $2,300,000 for the three-year term. This amount is included in the EHS FY 2023-24 Recommended Budget. Similar arrangements will be made for future budget years. The HHW program is funded through EHS fees assessed for each ton of solid waste landfilled, with no Net County Cost.
