BACKGROUND:

On February 9, 2021, this Board adopted Resolution No. 078001, which certified the Initial Study/Negative Declaration dated December 2020 and authorized the Director of Public Works to proceed with finalizing the plans and specifications and advertising for bids for the Mirada Road Pedestrian Bridge Replacement and Bank Stabilization Project (Project).

 

On April 5, 2022, this Board adopted Resolution No. 078816, which adopted plans and specifications including conformance with prevailing wage scale requirements, authorized an agreement with Gordon N. Ball, Inc., with a not-to-exceed amount of $4,073,520 for the Project, and authorized the Director of Public Works to execute change orders in an amount not to exceed $370,320.

 

On January 31, 2023, this Board adopted Resolution No. 079438, which increased the Director of Public Works’ authority to execute change orders to the agreement with Gordon N. Ball for the Project to increase the not-to-exceed amount of $4,073,520 by an additional amount of $275,000, to a new not to exceed amount of $4,348,520.

 

DISCUSSION:

During construction, the California Coastal Commission (CCC) required modifications to the concrete staircase requiring it to be redesigned and lengthened. This change required a significant amount of work including additional survey work, excavation, concrete form work, materials, and labor. Additionally, the increased creek flows from the 2023 winter storms required modifications to the construction strategy for the lower section of the concrete staircase. The Contractor had to construct a temporary cofferdam and manage an extensive dewatering system for the staircase work to proceed, which was not originally included in the Project plans.

 

Additionally, the CCC required additional amenities to be installed after the Project was awarded, which resulted in extra time, materials, and labor needed to complete the Project. 

 

These unexpected changes have extended the construction duration, increased the construction cost, and will result in the completion of the concrete staircase and remaining contract items in Fall of 2023. The cost of the unanticipated additional work for the Project is approximately $380,000.

 

The Department recommends that this Board consider these unanticipated conditions and approve the recommended contract increase amount to facilitate completion of the Project in 2023. The Department is working diligently through construction of the Project to minimize additional costs and develop solutions that are timely, effective, and financially responsible.

 

County Attorney has reviewed and approved the Resolution as to form.

 

FISCAL IMPACT:

The new not-to-exceed amount of the Gordon N. Ball, Inc. contract is $4,728,520. The recommended increase of the Project contract by $380,000 will allow for the payment to the Contractor to complete the above-described unanticipated and additional work. Funds have been allocated in the Capital Projects FY 2023-24 Adopted Budget to fund this Project.
