BACKGROUND:

An acute inpatient psychiatric unit inside a correctional facility provides beds for incarcerated persons in need of involuntary psychiatric care. An inpatient unit also allows incarcerated persons to be fully evaluated and treated onsite. Additional beds are filled with incarcerated persons transitioning to a sub-acute level of psychiatric care, such as those who no longer meet the criteria for involuntary treatment but who still need to stabilize further before being housed in the general population. Once an incarcerated person stabilizes to the point where a less intensive setting is appropriate, they are discharged to a less intense level of care, such as the Behavioral Health Unit, designed to enhance and expand mental health treatment for incarcerated persons.   

 

The acute psychiatric needs of incarcerated persons in San Mateo County have historically been met through two contracted beds at Santa Clara County. In January 2016, Santa Clara County ended that agreement. Through a Request for Proposals (RFP) in 2018, Correctional Health Services (CHS) entered into an agreement with Liberty Healthcare Corporation (Liberty) to manage a 10-bed acute inpatient psychiatric unit in the Maguire Correctional Facility that expires June 30, 2023. 

 

DISCUSSION:

CHS conducted an RFP in December 2022 for these services, and the selection committee agreed that Liberty was the best qualified to continue providing these services. Liberty has direct experience implementing and operating multiple jail-based psychiatric forensic units and correctional mental health services for four different California county sheriffs’ departments and the California Department of State Hospitals. CHS wishes to enter into an agreement with Liberty to continue to provide acute inpatient psychiatric services for adult detainees on both voluntary and involuntary treatment statuses, including the management of acute inpatient psychiatric units designed under the Lanterman-Petris-Short Act.   

 

The agreement and resolution have been reviewed and approved by the County Attorney as to form.

 

The resolution contains the County’s standard provisions allowing amendment of the County’s fiscal obligations by a maximum of $25,000 (in aggregate).

 

It is anticipated that less than 10% of incarcerated persons will be discharged from the acute inpatient psychiatric unit to administrative segregation.

FISCAL IMPACT:

The term of this agreement is July 1, 2023, through June 30, 2026. The amount of the agreement is not to exceed $10,939,956 for the three-year term. General funds in the amount of $292,050 are included in the FY 2023-24 Recommended Budget and annual contract amounts will be included in future Recommended budget years. There is no increase in Net County Cost for this contract.
