A)                     The President of the Board of Supervisors to execute an amendment to the agreement with Skidmore, Owens, & Merrill, LLP, for architectural and engineering services for County Office Building 3 in the amount of $736,122 for additional design service requests; and

 

B)                     The Director of the Project Development Unit, or designee, to execute subsequent change orders that modify the terms and conditions and increase the maximum fiscal obligation by five percent in aggregate or $566,744.23 for a total not to exceed contract value of $11,901,628.73.

BACKGROUND:

On June 23, 2020, this Board adopted Resolution No. 077488 which authorized the President of the Board of Supervisors to execute an agreement with Skidmore, Owings, & Merrill, LLP (SOM) for the design and engineering of County Office Building 3 (COB3). Under the direction of the Board, COB3 upon completion, will be an approximately 200,000 square foot office building designed to achieve sustainability goals including certification in Leadership in Energy and Environmental Design (LEED) and Zero Net Energy.

 

DISCUSSION:

SOM was recently asked to propose a landscape re-design of the County Center Civic Promenade that compliments the landscape surrounding COB3 for a more cohesive landscape experience for the public and the surrounding community. The specific scope of service consists of analyzing the existing conditions and infrastructure, integration and enhancement of the existing conditions, coordination, management of the architectural design, civil design, graphic design, landscape design, technology and structural engineering design, providing construction documents, coordinating the new construction document (CD) permit set, answering plan check comments, assisting in obtaining the permit, and provide construction administration phase observation services.

This amendment will authorize the additional commissioning of the County’s Civic Landscape and nine additional service requests all totaling $736,122 and will adjust the SOM current contract value to $11,334,884.50. These additional services include, inter alia, Furniture, Fixture, & Equipment (FF&E) consulting and management, design and engineering of the County Civic Promenade and construction document development, County Civic Center Lighting, changes to department floor layouts, Pacific Gas and Electric (PG&E) service vault, revisions to add additional Americans with Disabilities Act (ADA) parking surrounding COB3, civil design improvements to the promenade, and campus site signage.

 

This additional authorization is required due to the nature and size of the construction project that will inevitably include unexpected costs as the County moves forward on the renovation and beautification of the County Center promenade, as well as the Veteran’s Memorial Site coordination, for the benefit of the community and staff.

 

The amendment also provides the Director of the Project Development Unit with the authority to execute change orders that modify the terms and conditions and increase the maximum fiscal obligation under the agreement by 5% in aggregate or $566,744.23.  This additional authorization is required due to the nature, size, and overall complexity of the COB3 construction project that will inevitably include some additional, unexpected costs as the County moves forward on the renovation and beautification of the County Center promenade, as well as the Veteran’s Memorial Site coordination.

 

County Attorney has reviewed and approved the agreement and resolution as to form.

 

EQUITY IMPACT:

The redesign of the landscape surrounding the COB3 project will positively impact all residents who visit the County Civic Promenade by providing a beautified, welcoming context to the nearby County buildings. Required features such as nearby accessible parking will ensure residents of all abilities can fully access County services at County Center buildings.

 

FISCAL IMPACT:

Funding for this agreement is appropriated under the County’s 2018 JPFA Lease Revenue Bonds. There is no impact to the General Fund.
