BACKGROUND:

Job Order Contracting (JOC) is a task-based method of project delivery whereby contractors (e.g. general, mechanical, electrical, utilities or road contractors) agree to perform various construction tasks for a set fee. JOC has been extensively utilized at the federal, state, and local government levels for over 26 years.

 

On August 4, 2020, this Board approved Resolution No. 077667, which authorized the most recent agreement with The Gordian Group, Inc. (Gordian) to develop, implement, and support the JOC eGordian system for the Department of Public Works (Department) for a term of August 8, 2020 through August 7, 2023 with a not-to-exceed amount of $500,000.

 

The Department has made increasing and substantial use of this contracting system since its implementation at the County in 2008 and over $60,000,000 in projects have been completed under the program. Gordian supports the Department’s use of the JOC eGordian system, work requested of and performed by the JOC contractors, and the agreement specifies the payment requirements for Gordian’s services, which are generally dependent upon the value of JOC work completed.

 

On October 18, 2022, by authority of Resolution No. 077667, the Director of Public Works executed Amendment No. 1 increasing the not to exceed amount by $25,000 for a new not to exceed amount of $525,000 with no change in term.

 

DISCUSSION:

The Department requests to extend the agreement with Gordian and its proprietary software system, eGordian, to remain the sole provider to track and manage the County’s 24 JOC contracts. eGordian has been customized to fit the County’s JOC needs. It is in the best interest of the County and the Department to continue using the eGordian software to continue maximizing project delivery.

 

The County Attorney’s office has reviewed and approved the resolution and amendment as to form.

 

FISCAL IMPACT:

Amendment No. 2 to the Agreement increases the not to exceed amount by $250,000 for a new not to exceed amount of $775,000 and extends the term through August 7, 2025. Funding for this amendment is included in the Capital Projects FY 2022-23 Approved Budget.

 

There is no additional impact to the General Fund.
