BACKGROUND:

On July 9, 2020, the County entered into an agreement with San Mateo County Economic Development Association (“SAMCEDA”) to help small and medium sized businesses recover from the economic impacts of the COVID-19 pandemic for the term June 9, 2020 to January 9, 2021 in an amount not to exceed $75,000 (the “Agreement”).

 

Since then, the County has entered into seven previous amendments of the Agreement which, in aggregate, have increased the Agreement’s maximum fiscal obligation by $759,810, to a current not-to-exceed amount of $834,810, and extended the term of the Agreement through March 31, 2023.

 

The County now wishes to amend the Agreement for an eighth time to increase the maximum fiscal obligation by an additional $92,421, for a new not-to-exceed amount of $927,231, in order to cover SAMCEDA’s additional pandemic recovery-related work performed in partnership with the Peninsula Chinese Business Association (“PCBA”) (“Eighth Amendment”).

 

DISCUSSION:

Early in the pandemic, SAMCEDA partnered with PCBA, which distributed COVID-19-related health guidance and completed business compliance checklists to 550 small businesses throughout the North County. PCBA staff also helped organize restaurant worker vaccination events, translated COVID-19 health guidance materials, small business grant application forms, and frequently asked questions (FAQ) documents, and staffed in-language helplines for County-sponsored grant programs.

The Eighth Amendment increases the total amount payable under the Agreement by $92,421 to cover PCBA’s additional outreach work for the County’s recent small business assistance programs-including the second round of small business grants, the restaurant, brewery and wineries grants, and the micro-food business grants-and its assistance with development of the San Mateo County small business directory through the Choose Local app outreach program. This work was complete after September 2021 and the total amount of $92,421 has already been paid to SAMCEDA to compensate PCBA. 

The Eighth Amendment increases the Agreement by that same amount to cover SAMCEDA’s services through March 2023, since the additional $92,421 was paid from funding that was originally designated for SAMCEDA’s portion of the contracted work under the Agreement.

The County Attorney’s Office has reviewed and approved the Eighth Amendment and accompanying resolution as form.

 

FISCAL IMPACT:

The Eighth Amendment will be funded exclusively with American Rescue Plan Act (ARPA) funds to the extent available and eligible. However, to the extent appropriate, these costs may ultimately be covered by reimbursement from funds provided through other County, state and/or federal funds that may be made available in connection with the County's response to the COVID-19 pandemic. The $92,421 in ARPA funds for the Eighth Amendment are included in the FY 2022-23 adopted budget.
