BACKGROUND:

Dr. Osher has been a contracted child psychiatrist for Behavioral Health and Recovery Services (BHRS) since 2003, providing services at various County mental health clinics. Services include child and youth medication evaluation and treatment, psychotherapy and family consultation, residency training, and case consultation to staff. In July 2022 this Board approved an agreement with Dr. Osher to provide psychiatry services for the term July 1, 2022, through June 30, 2025, in the amount of $1,043,328.

 

DISCUSSION:

Compensation for BHRS contracted physicians has been equivalent to compensation for County employed physicians, whose rates are determined through negotiated Memoranda of Understanding (MOU) with the Union of American Physicians and Dentists (UAPD). When the current agreement with Dr. Osher was being negotiated, the County was also negotiating a new MOU with UAPD. The current agreement with Dr. Osher includes a stipulation that the contracted rate of compensation would be adjusted to maintain equivalency with a new UAPD MOU rate. The new MOU is now in place and this amendment provides Dr. Osher with the stipulated rate increase.

 

Under the B-1 Administrative Memorandum, agreements with physicians are exempt from the requirement for a Request for Proposals process.

The resolution contains the County’s standard provision allowing amendment of the County’s fiscal obligations by a maximum of $25,000 (in aggregate).

The agreement and resolution have been reviewed and approved by County Counsel as to form.

 

It is anticipated that eighty percent (80%) of clients served will maintain their current or lower level of placement.

FISCAL IMPACT:

The term of the agreement remains July 1, 2022, through June 30, 2025. The original maximum amount of $1,043,328 is being increased in the amount of $235,473 to a new maximum of $1,278,801 for the three-year term. Funds in the amount of $412,372 are included in the BHRS FY 2022-2023 Adopted Budget, which is an increase of $64,596.

Of the $412,372 amount, Medi-Cal will fund $206,186; 1991 Realignment will fund $41,237; and 2011 Realignment for Early Periodic Screening, Diagnosis and Treatment (EPSDT) will fund $164,949. There is no Net County Cost.
