A)                     Authorizing an amendment to the agreement with SBay Construction, Inc., increasing the amount by $402,865 for a new not to exceed amount of $5,402,865 without change in term; and

 

B)                     Authorizing the Director of Public Works, or the Director’s designee, to issue Work/Job Orders, execute Change/Revision Orders, and make financial and administrative changes to the executed Job Order Contract agreement.

BACKGROUND:

On November 19, 2013, this Board adopted Resolution No. 072896, which authorized the Director of Public Works to proceed with preparing plans and specifications, and conformance with prevailing wage scale requirements for Job Order Contracts (JOC), and advertising for bids (streamlined process).

 

On February 8, 2022, this Board adopted Resolution 078712(b), which authorized the JOC Agreement with SBay Construction, Inc. to provide general construction services for repair, remodeling, or other repetitive work to be completed on County maintained facilities.

 

DISCUSSION:

The Department of Public Works (Department) has been tasked with repairing and remodeling various County owned hotels. This work has been deemed a priority for the County to assist in the ongoing goal to house those within the County who are experiencing homelessness. SBay Construction, Inc. has the unique ability and resources to provide the management, supervision, and workforce to complete this work in an efficient manner giving the County the opportunity to occupy the facilities as early as possible.

 

This amendment to the agreement with SBay Construction, Inc. increases the not-to-exceed amount to $5,402.865 to complete the work necessary for repair, remodeling, and other repetitive work in County owned facilities. All other terms of the JOC Agreement remain in full force and effect.

 

County Attorney has reviewed and approved the resolution and agreement as to form.

 

FISCAL IMPACT:

The amendment to this agreement increases the current amount by $402,865, for a new not to exceed maximum fiscal obligation $5,402,865. The JOC is a requirements agreement. The various individual job orders will be funded through previously approved and appropriated projects within the FY 2021-22 Adopted Budget. There is no additional impact to the General Fund.
