A)                     Accepting the certificate of the Chief Elections Officer as the statement of the results of the vote as determined by the official canvass of the June 7, 2022 Statewide Direct Primary Election (the “Election”); and

 

B)                     Declaring elected to or nominated to each office voted on at the Election the persons having the highest number of votes for such offices.

BACKGROUND:

On June 7, 2022, the Chief Elections Officer conducted the Election. The official canvass and an abstract or Statement of the Vote for the Election was completed and certified by the Chief Elections Officer and is now available at the Registration & Elections Division.  An electronic copy of the Statement of the Vote is also published on the Registration & Elections Division website, www.smcacre.org <http://www.smcacre.org>, and a copy has been submitted to the Board, as required by state law. 

 

DISCUSSION:

Within 30 days of an election the Chief Elections Officer is required to inspect, process, and count all ballots cast during an election and prepare a certified statement of the result.  Upon acceptance of this certified statement, Elections Code Section 15400 directs the governing body of the jurisdiction-here, the Board of Supervisors-to declare elected or nominated to each office voted on at the election the persons having received at least a majority and the highest number of votes for such office.

 

Staff recommends that the Board accept the certificate of the Chief Elections Officer as the statement of the results of the vote as determined by the official canvass of the Election.  Further, in the proposed Resolution, persons having received at least a majority and the highest number of votes at the Election, as reflected in the certificate, will be declared elected to the following offices:  one Superior Court Judge; Assessor-County Clerk-Recorder; Controller; Coroner; District Attorney; Sheriff; County Superintendent of Schools; and Treasurer-Tax Collector. 

 

The County Attorney has reviewed and approved the Resolution as to form.
