BACKGROUND:

On March 3, 2020, the County’s Health Officer issued a “Declaration of Local Health Emergency Regarding Novel Coronavirus 2019,” and the County Manager, as the County’s Director of Emergency Services (“Director”), issued a proclamation of local emergency pursuant to Government Code section 8630 and Chapter 2.46 of the County’s Ordinance Code, which proclamation was ratified by the Board on March 10, 2020, pursuant to Government Code section 8630, and extended by the Board on April 7, 2020, until such time as the local emergency is terminated ( “COVID-19 Local Emergency”).

 

In response to the COVID-19 Local Emergency, the County’s Emergency Operations Center (“EOC”) was engaged to assist in the County’s response.  Pursuant to Resolution No. 077305, and in accordance with Government Code Section 25502.7, effective January 1, 2022, the Director entered into an agreement with the Event Center for the provision of facilities, personnel services, and supplies to house and support the County’s COVID-19 mass vaccination site through June 30, 2022 for an amount not to exceed $500,000 (“Agreement”).

 

DISCUSSION:

The Event Center has been a reliable partner throughout the COVID-19 Local Emergency, and the services provided under the Agreement have been critical components of the County’s COVID-19 response efforts.  Due to the ongoing COVID-19 Local Emergency, the County has a continuing need for these services and staff therefore recommends that the Board authorize an amendment to the Agreement increasing the maximum amount payable thereunder by $375,000, from $500,000 to an amount not-to-exceed $875,000 (“Amendment”).

In addition, the EOC is requesting that the Board waive the formal solicitation process for the Amendment pursuant to Ordinance Code 2.83.050(e) in order to ensure continuation of critical services to the public in response to the COVID-19 Local Emergency.

 

County Attorney has reviewed and approved the resolution as to form.

 

FISCAL IMPACT:

This Amendment will increase the amount payable under the Agreement by $375,000, bringing the total amount that may be expended under the Agreement to $875,000. The Agreement was included in the FY2021-22 Adopted budget and anticipates that the $375,000 will be claimed to Federal Emergency Management Agency. However, to the extent appropriate, these costs may ultimately be covered by reimbursement from funds provided through other funds that may be made available in connection with the County’s response to the COVID-19 pandemic.
