BACKGROUND:

Cash Assistance Program for Immigrants (CAPI) is a fully state-funded program that provides cash assistance to certain aged, blind and disabled legal immigrants who are not eligible for Supplementary Security Income/State Supplementary Payment (SSI/SSP) benefits solely due to the immigrant provisions of the Welfare Reform Law. The program is based on the federal regulations governing the Social Security Administration for the SSI program, specifically Welfare and Institutions Code Section 18940 and in Section 49-013. Grant amounts for eligible individuals are equal to SSI/SSP levels.

 

The counties of San Mateo, Alameda, Contra Costa, Marin, Merced, Monterey, Santa Cruz, Solano, Sonoma, and Stanislaus have collaborated to establish the Bay Area CAPI Consortium. On March 21, 2000, the County of San Mateo’s Board of Supervisors approved the Memorandum of Understanding (MOU) by Resolution 63488 to establish the Consortium.

 

On April 7th, 2018, by Resolution No. 076069, the County entered into a non-financial agreement with CAPI Consortium member counties for the term of July 1, 2018 to June 30, 2022, that identifies San Mateo County as the administrator of state funds for the CAPI program.

 

DISCUSSION:

The Human Services Agency (HSA) is requesting the Board authorize a non-financial Memorandum of Understanding (MOU) agreement with the CAPI consortium member counties for the term of July 1, 2022 to June 30, 2026. As the lead County for the Bay Area CAPI Consortium, San Mateo County is responsible for administering funding for the Consortium. In this capacity, the County of San Mateo receives state funding on behalf of all Consortium Counties and administers payments to eligible recipients within their respective county.  In the event of a state budget impasse, each county is responsible for advancing funds for their recipients to the County of San Mateo.

 

HSA is further requesting the Board authorize the Director of HSA, or designee, to execute the MOU agreement, and any future amendments to accommodate the consortium member counties’ contract review and execution process which require a signed resolution by this Board before they can execute the MOU.

 

The agreement and resolution have been reviewed and approved by County Attorney as to form. 

 

It is estimated that 90% of CAPI applications, that are non-disability related, will be dispositioned in a timely manner by the County of San Mateo and by working with the Bay Area Consortium Counties.  A timely disposition will consist of an application being approved or denied within 30 days of application. The standard set by the state for non-disability related applications dispositioned on time is 90%. The County is expected to meet or exceed that performance measure based on past performance.

FISCAL IMPACT:

This Memorandum of Understanding will incur no Net County Cost. All CAPI payments, administrative costs and other CAPI-related expenditures are fully funded by the state. In the event of a state budget impasse, the County of San Mateo will make CAPI payments and then invoice the Consortium Counties within five business days. Consortium Counties, per the MOU, shall make reimbursements to the County of San Mateo within 10 business days, subject to and contingent upon compliance with provisions listed in the agreement. Appropriation is included in the Recommended Budget for FY2022-2023 and will be included in future budgets.
