Adopt a resolution authorizing an agreement with Advance Chemical Transport, Inc dba ACTenviro to provide training, packaging, labeling, shipping, transporting, and recycling of universal waste lamps and batteries collected by the retail take-back partner stores, for the term of March 13, 2022 through March 12, 2025, in an amount not to exceed $400,000.

BACKGROUND:
On October 20, 2021, Household Hazardous Waste (HHW), one of San Mateo County Environmental Health Services Division’s (EHS) programs, issued a Request for Proposals for disposing hazardous waste, including transporting and recycling universal waste fluorescent lamps and batteries. Three proposals were received, and EHS selected Advance Chemical Transport, Inc dba ACTenviro (ACTenviro) because it offered the best value for the services requested.
DISCUSSION:
HHW collects and safely processes household hazardous waste from County residents. Contracting with ACTenviro would enhance this program by providing universal waste lamp and battery direct pick-ups at retailer store locations. In addition, ACTenviro would supply the retailer with the necessary equipment, supplies and training of in-store staff to ensure proper management, containment and storage of the universal waste lamps and batteries collected.
The resolution contains the County’s standard provisions allowing amendment of the County fiscal obligations by a maximum of $25,000 (in aggregate).
The agreement and resolution have been reviewed and approved by County Counsel as to form.
It is anticipated that 10,000 pounds of batteries and 70,000 feet of universal waste fluorescent lamps will be diverted from landfill disposal per year.

FISCAL IMPACT:
The term of this agreement is March 13, 2022 through March 12, 2025. The amount of the agreement is not to exceed $400,000 for the three-year term. An appropriation of $400,000 is included in the EHS FY 2021-22 Adopted Budget. Similar arrangements will be made for future budgeted years. One hundred percent of the agreement amount will be paid by AB939 fees. There is no Net County Cost associated with this agreement.
