Adopt a resolution authorizing:
A) The President of the Board to execute a Permit Agreement with T-Mobile West, LLC for their continued operation of a wireless communication facility at the Tower Road Communication Facility in San Mateo, for a term of five (5) years with one option to extend for an additional five years, at a monthly Base Permit Fee of $4,000; and
B) The County Manager, or his designee, to accept and execute on behalf of the County any and all notices, options, consents, approvals, terminations, and documents in connection with the Permit Agreement (Permit No. 5234).

BACKGROUND:
T-Mobile West, LLC (“T-Mobile”) has occupied space at the County’s Tower Road Complex, located at 20 Tower Road, in San Mateo, (“Property”), since 1996. T-Mobile currently occupies approximately 300 square feet of ground space for the installation, construction, operation and maintenance of a communications facility. Execution of the Permit Agreement will authorize T-Mobile to continue to operate a wireless communication facility at a Monthly Base Permit Fee of $4,000.00, for a term of five years with one option to extend for an additional five years.
DISCUSSION:
Real Property Services has negotiated a Permit Agreement with T-Mobile, for a term of five (5) years, with one option to extend the term for an additional five years. The initial Monthly Base Permit Fee is $4,000.00, subject to annual increases of 3%.
County Counsel has reviewed and approved the amendment as to form. The Director of Public Works concurs with this recommendation.
FISCAL IMPACT:
The current fiscal year’s revenue of $48,000.00 ($4,000.00 x 12 months) will be received in the form of monthly rent payments and will be deposited into the Other Rents & Concessions fund (47310-1559) in the Department of Public Works.
