A)                     The President of the Board of Supervisors to execute a Permit Agreement with CCATT LLC (“Permittee”), for the continued operation of a wireless communication facility at the Pescadero Quarry Communication Site located off of Bean Hollow Road, San Mateo, California, also known as County Assessor Parcel Number 086-180-060 (“property”) at an initial monthly rate of $3,128.80, for a five year term, with one option to extend for an additional five years, and

 

B)                     The County Manager, or his designee, to accept or execute notices, options, and documents associated with the Agreement including, but not limited to, extension or termination of the Agreement under the terms set forth therein.

BACKGROUND:

In 1994, the County and Bay Area Cellular Telephone Company (“BACTC”) entered into a Permit Agreement for the installation, construction, and operation of a wireless communication facility at the Pescadero Quarry Communication Site.  BACTC was sold to New Cingular Wireless PCS, LLC (“Cingular”) in 2001. Cingular was later assigned to a corporation that CCATT LLC acquired in 2013. Since October 2015, CCATT LLC has operated at this site on a month-to-month basis in accordance with the holdover provision of the Permit.  The current monthly rent is $2,971.35. 

 

The new permit agreement for Board’s consideration and approval will consist of 1,340 square feet of ground space for the installation and operation of the equipment described in Exhibit B of the Agreement.

 

DISCUSSION:

Real Property Services has negotiated a Permit Agreement for a term of five years, with one option to extend for an additional five years. The initial monthly fee of $3,128.80 is based upon ISD Radio Site Equipment Rates for installed equipment and subject to annual 3% escalation.  The Permittee plans to replace the existing equipment, and as a condition of the permit, the Permittee must make improvements to the access road so that a fire truck can access and turn around at the site.

 

County Counsel has reviewed and approved the Permit and Resolution as to form.  The Director of Public Works concurs in this recommendation.

 

FISCAL IMPACT:

The fee of $37,545.60 for the initial year of the five-year term will be deposited to the Department of Public Works County Land Fund.
