BACKGROUND:

On October 23, 2018, this Board adopted Resolution No. 076242n, which authorized an agreement (Agreement) with Cal Engineering & Geology (CEG) for On-Call Engineering Professional Services for a not-to-exceed amount of $500,000 with a term of three (3) years through October 22, 2021 and authorized the Director of Public Works to execute contract amendments to modify the County’s maximum fiscal obligation by no more than $25,000 (in aggregate) and/or modify the contract term and/or services.

 

On March 19, 2021, the Director of Public Works executed Amendment No. One to the Agreement with CEG, which increased the not-to-exceed amount of the agreement by $25,000 to $525,000 for ongoing design engineering work for the Higgins Canyon Road Slip-Out Repair Project.

 

DISCUSSION:

CEG’s services are currently being used for the Higgins Canyon Road Slip-Out Repair Project and the Scenic Drive Repair and Reconstruction Project. Amendment No. Two extends the term of the Agreement to January 31, 2022 and increases the not-to-exceed amount by $815,786 to provide additional design engineering, bid support, and construction administration support services through the end of construction for both Projects.

 

CEG provided a greater level of effort than originally anticipated during the design phase of the Higgins Canyon Road Slip-Out Repair Project to determine the limits of the County’s road right-of-way due to the limited available survey information. After the road right-of-way (ROW) limits were established, the Department requested that CEG’s design for the Project be restricted to the road ROW as much as possible, which required additional effort. Upon review, the design was modified to better address the source of the damage including the surface run-off from the road that was contributing to the embankment erosion. CEG also had to incorporate bio-stabilization elements into the design to address the requirements of the environmental permitting agencies.

 

CEG was required to provide additional design engineering services for the Scenic Drive Repair and Reconstruction Project to complete the construction bid documents and satisfy the requirements of the funding approval process with the Federal Emergency Management Agency.

 

CEG’s additional efforts for both Projects and the anticipated construction timeline for each Project have necessitated the need for Amendment No. Two.

 

County Counsel has reviewed and approved the resolution and amendment as to form.

 

FISCAL IMPACT:

Amendment No. Two will increase the not-to-exceed Agreement amount by $290,786 to $815,786. Funds to pay for GEG’s services in connection with this amendment will be from the Road Fund.

 

There is no impact to the General Fund.
