BACKGROUND:

In December 2018, the County of San Mateo’s Environmental Health Services (EHS) conducted a Request for Proposals (RFP) for packaging, labeling, shipping, transporting, and recycling of universal waste lamps and batteries collected by the Retail Take-Back Partner Stores. ACTenviro, a nationally-recognized environmental and hazardous waste management firm, and one of the top 100 recyclers in the United States, was ultimately selected through the RFP process to provide these services. With your Board’s approval (Resolution No. 076477), EHS and ACTenviro entered into an agreement (the “Agreement”) for ACTenviro to provide these services for a term of March 13, 2019 through March 12, 2022, with a total amount not to exceed $175,000.

 

This Agreement supports the Household Hazardous Waste Collection Program by diverting residential batteries and fluorescent lamps collected at partner retail hardware stores from landfill disposal.

 

DISCUSSION:

Due to the COVID-19 response, hardware stores remained open as essential services, becoming the only disposal option available to the public for several months during the pandemic and thus, exceeding expected volumes. As a result, EHS is requesting your Board to authorize an amendment to the agreement that will increase its amount by $100,000, to a total amount not to exceed $275,000.

                     

The amendment to the agreement and resolution have been reviewed and approved by County Counsel as to form.

 

The resolution contains the County’s standard provisions allowing amendment of the County fiscal obligations by a maximum of $25,000 (in aggregate).

 

It is anticipated that a minimum of 11 partner retail hardware stores will receive packaging, labeling, shipping, transporting and recycling of universal waste lamps and batteries between January 1, 2021 and June 30, 2021.

FISCAL IMPACT:

The term of the amended agreement is March 13, 2019 through March 12, 2022. The amount of the amended agreement is $275,000. This amendment increases the contract amount by $100,000. Funds in the amount of $80,000 are included in the EHS FY 2020-21 Approved Budget. Funds in the amount of $20,000 are included in the EHS FY 2021-22 Recommended budget. This contract is 100% funded by solid waste tipping fees (AB939 revenue); no Net County Cost is associated with this agreement.
