Adopt a resolution authorizing an agreement with Gordon Mak, MD, to provide pulmonary and critical care services for the term of August 1, 2020 through July 31, 2022, in an amount not to exceed $1,000,000.

BACKGROUND:
San Mateo County is responsible for providing necessary medical care to its medically indigent population, and access to services to its general population. Dr. Mak has been providing pulmonary and critical care services at San Mateo Medical Center (SMMC) since 2007 and will continue to provide at least, the same level that he currently provides to the County.
DISCUSSION:
The County’s need for pulmonologist is increasing due to the aging of its patient population and the current COVID-19 pandemic. SMMC will continue to meet this growing need through contracts with Dr. Mak and other pulmonologists. Dr. Mak has agreed to provide the necessary clinic, test interpretation, and call coverage for County patients. In addition, Dr. Mak will have the role of Medical Director of Pulmonary.
County Administrative Memorandum B-1 provides that contracts for physicians are exempt from the Request for Proposals process.
The agreement and resolution have been reviewed and approved by County Counsel as to form.
The resolution contains the County’s standard provisions allowing amendment of the County fiscal obligations by a maximum of $25,000 (in aggregate).
It is anticipated that Dr. Mak will timely complete accurate billing records 85% of the time.

FISCAL IMPACT:
The term of the agreement is August 1, 2020 through July 31, 2022. The amount of the agreement is not to exceed $1,000,000 for the two-year term. Funds in the amount of $458,333 are included in the SMMC FY 2020-21 Recommended Budget. Funds in the amount of $500,000 are included in the SMMC FY 2021-22 Recommended Budget. Similar arrangements will be made for future years.
The payment provisions have increased from the prior agreement to be consistent with Medical Group Management Association rates, which SMMC uses to benchmark physician contract compensation.
Expenses at SMMC are covered by fees for services or third-party payors whenever possible. The portion of expenses for services provided to the medically indigent or to those covered by programs that do not meet the full costs of care is covered by the County’s General Fund contribution to SMMC and is within the existing annual appropriation.
