B)                     The County Manager, or County Manager’s designee, to execute escrow instructions, notices, consents, approvals, and any other documents in connection with the vacation by Burlingame of the old water pipeline easement and the new Easement Deed and Agreement for Water Pipeline.

BACKGROUND:

In 1981, the County granted the City of Burlingame (“City”) a ten-foot wide easement for a water main line across Assessor’s Parcel Number 029-321-060 in front of the old animal shelter complex near Coyote Point Recreation Area. The City’s water main originates from the north under Airport Boulevard right of way.  The easement granted to the City in 1981 was for a segment that made a ninety-degree turn into County property before making a large loop and returning to Airport Boulevard right of way further to the south (“Old Water Line Segment”).  This segment of the water line included a water meter and fire hydrant. 

 

As a condition to the demolition and construction of the County’s new animal control facility, it was necessary to relocate the Old Water Line Segment owned, operated and maintained by the City of Burlingame, to a location at or near Airport Boulevard right of way.

 

DISCUSSION:

The Real Property Division has assisted the Project Development Unit with the preparation of an Easement Deed and Agreement for Water Pipeline (“New Water Line Easement”) for the purpose of conveying the relocated water line easement and dedicating the water line facilities to the City. The New Water Line Easement is conveyed to the City subject to existing rights and encumbrances and it reserves to the County the right to connect to the water line.

 

The County can execute the New Water Line Easement on the terms and conditions set forth therein provided the conveyance is in the public interest and the interest in land conveyed will not substantially conflict or interfere with the use of County property. The Easement sets forth critical public uses and returns the water line facilities to a better location at or near the right of way. The City approved the vacation of the Old Water Line Segment and the resolution of the vacation will be recorded contemporaneously with the recordation of the New Water Line Easement.

 

The Project Development Unit concurs in this recommendation. County Counsel has approved the resolution and New Water Line Easement as to form.

 

 

FISCAL IMPACT:

There is no impact on the General Fund.  Staff time has been paid for by the Project Development Unit.
