RECOMMENDATION:

title

Adopt a resolution authorizing correction to a disbursement for excess proceeds previously authorized on March 10, 2020 from tax-defaulted sale and authorizing disbursement of excess proceeds.

body

BACKGROUND:

On 8/4/2018 - 8/6/2018 and 9/8/18 - 9/10/18, the Office of the Tax Collector, with your Board’s approval, conducted a tax sale pursuant to Revenue and Taxation Code Section 3691 et seq. Excess proceeds were collected, and your Board authorized distribution of those proceeds in accordance with timely filed claims on 3/10/2020.  Subsequently, it was discovered that the Tax Collector had requested approval to distribute excess proceeds directly to an individual, rather than to the agent who had filed on their behalf.

DISCUSSION:

The Tax Collector has identified that previously authorized distribution of Excess Proceeds in the amount of $391,048.05 should be directed to Global Discoveries, LLC rather than directly to Mary Joann Likas.  Global Discoveries files the excess proceeds claim on behalf of Mary Joann Likas, and is acting as their agent in this matter.

It is recommended that the Board accept the correction to the previously authorized Excess Proceeds distribution, and authorize distribution to Global Discoveries, LLC rather than Mary Joann Likas.

FISCAL IMPACT:

There is no impact to the general fund.
