BACKGROUND:
Existing State law requires California fire departments to enforce the fire code as adopted. Additionally, fire departments are required to perform annual inspections of every building used as a public or private school (used by more than six persons at any one time), as well as all apartment houses (with three units or more), hotels, motels, and lodging houses, for compliance with the adopted codes.
FINDINGS:
In calendar year 2019, the San Mateo County Fire Department conducted 12 (of 12 on record) educational or ‘E’ occupancy-type inspections (100% completion rate) and 6 (of 6 on record) residential or ‘R’ occupancy-type inspections (100% completion rate). The percentages of inspections completed are based on fire department records for each type of businesses for which State law requires an inspection.
DISCUSSION:
After the devastating Ghost Ship Fire in Oakland, the State adopted Senate Bill 1205 in 2018. SB 1205 added Section 13146.4 of the California Health and Safety Code, which adds a reporting requirement to the mandatory inspections for certain educational and residential structures, described above. Every city or county fire department or district is now required to report annually to its administering authority on the department's or district's compliance with the inspection requirements. SB 1205 also requires the administering authority to acknowledge receipt of the report in a resolution or a similar formal document.
The attached resolution, proposed for consideration by the Board of Supervisors, fulfills the San Mateo County Fire Department’s obligations pursuant to SB 1205.
