BACKGROUND:

California Welfare and Institutions Code (W&I), Division 9, Part 6, Chapter 5, otherwise called the “Domestic Violence Centers Act,” declares there is a present and growing need to develop innovative strategies and services which will ameliorate and reduce the trauma of domestic violence. 

 

The Domestic Violence Centers Act created a trust fund pursuant to Penal Code 1203.097, in which fees collected from specified defendants are placed in that fund.  The fees collected in this fund are to be disbursed for approved programs for the purpose of aiding victims of domestic violence. In April 2004, the San Mateo County Board of Supervisors recommended that CORA receive disbursements from two trust funds: Domestic Violence Trust Fund and Battered Women’s Shelter Trust Fund.

 

DISCUSSION:

In response to the Domestic Violence Centers Act, we are asking that the Board approve an agreement with CORA.  CORA is the only agency in the county with services solely dedicated to serving those affected by domestic violence meeting the requirements detailed in the Domestic Violence Centers Act, including emergency shelter, transitional housing, legal representation, advice and accompaniment, a 24-hour hotline, counseling, and community outreach. 

 

The Probation Department is also seeking a waiver of the Request for Proposals process in order to execute this contract due to CORA being a sole source provider of this service. It is in the County’s and the Department’s best interest to execute this agreement with the Contractor to ensure that it continues its business model of providing risk-based domestic violence treatment and support services in the county.

 

Since 2004, CORA:

 

                     Received and processed approximately 55,000 crisis calls

                     Provided crisis intervention peer counseling (individual and group) to approximately 15,000 individuals

                     Housed approximately 2,500 survivors and their children in CORA’s Emergency Shelter and Transitional Housing Programs

                     Provided legal assistance with temporary restraining orders and protective and/or custody orders for approximately 2,800 survivors

                     Assisted approximately 35,500 victims of domestic violence referred by local law enforcement agencies

                     Conducted outreach and education to over 32,000 teenaged and adult members of the San Mateo County community through the Community Education Program

 

The contractor has assured compliance with the County's Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits.

 

The Probation Department requests that the Chief Probation Officer or his designee be granted authorization to execute contract amendments that modify the County’s maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.

 

The term of the agreement is February 1, 2020, through January 31, 2023. The Agreement and Resolution have been reviewed and approved by County Counsel.

FISCAL IMPACT:

The term of the agreement is February 1, 2020, to January 31, 2023. The total obligation is $350,000. It is fully funded through the receipts collected from the specified defendants. The funds have been included in the FY 2019-2020 Adopted Budget and will be included in the FY 2020-2021, FY 2021-2022, and FY 2022-2023 budgets.
