BACKGROUND:

On January 29, 2019, your Board adopted Resolution No. 076380, in support of the “Flood and Sea Level Rise Resiliency Agency Proposal” (Proposal) for the new San Mateo County Flood and Sea Level Rise Resiliency District (FSLRRD). The Proposal included modifying the existing San Mateo County Flood Control District (SMCFCD) to enable additional water related activities, jurisdictional areas, and establish a new governance structure.  The Proposal recommended revising the 1959 San Mateo Flood Control District Act (Act) through special legislation (AB 825) to change the governance from the Board of Supervisors to a seven-member board consisting of five city/town council members nominated by the City/County Association of Governments (C/CAG) and two Board members appointed by your Board.

 

The FSLRRD’s mission and role is to address sea level rise, flooding, coastal erosion, and large-scale stormwater infrastructure improvements through integrated regional planning, design, permitting, project implementation, and long-term operations and maintenance to create a resilient “one shoreline” approach in San Mateo County by 2100.

 

On June 13, 2019, C/CAG appointed the five city/town representatives and on June 25, 2019, your Board adopted Resolution No. 076718, appointing two Board members to establish a seven-member Advisory Committee, which after the expected January 1, 2020 effective date of AB 825, will serve as the FSLRRD’s Board.

 

Mr. Patterson was a member of the Steering Committee and the Staff Advisory Team, that worked to define the general scope of the FSLRRD, timeline for establishing the FSLRRD, agency participation levels, and other details required.  Because of Mr. Patterson’s professional experience and involvement in the FSLRRD formation it was determined that he was uniquely qualified to provide consulting services for the FSLRRD. Through a non-competitive process, the Department executed an agreement with Larry Patterson, d.b.a. Coast Consulting, on January 7, 2019, with a not to exceed amount of $100,000 and a term through January 6, 2020. The services provided to date have included oversight and direction on the formation and initial operations of the FSLRRD. Should AB 825 be approved, the SMCFCD and Enhanced Flood Program would transition to the FSLRRD effective January 1, 2020. 

 

DISCUSSION:

On July 12, 2019, the Advisory Committee voted to appoint Larry Patterson, d.b.a. Coast Consulting, as the interim General Manager of the future FSLRRD.  Mr. Patterson has been tasked with: managing the formation of the FSLRRD and supporting the Advisory Committee; acting as the point of contact for other public agencies, stakeholders and the public; recommending staff and securing office space; identifying who will provide administrative, financial, and human resources support; and making start-up decisions to enable the operations of the FSLRRD on January 1, 2020.

 

Mr. Patterson has a vast knowledge of the goals and role of the FSLRRD and is uniquely qualified to assist the Advisory Committee and staff in its mission. Mr. Patterson’s continued services are needed to support the formation of the FSLRRD, serve as an interim General Manager/staff to the Advisory Committee, and to complete administrative and financial system start-up tasks necessary for the successful transition to the FSLRRD by January 1, 2020. The Department recommends that your Board find that it is in the best interest of the County to waive the request for proposal process for this amendment. 

 

County Counsel has reviewed and approved the resolution and amendment as to form.

 

Approval of this resolution will contribute to the Shared Vision 2025 outcome of a Collaborative Community by working on a multi-jurisdictional approach to addressing sea level rise, flooding, coastal erosion, and large-scale stormwater infrastructure improvements that benefit communities within the County.

 

FISCAL IMPACT:

Approval of this resolution will increase the agreement amount by an additional $35,000 to a new, not-to-exceed amount of $135,000 with no change in term, from January 7, 2019 to January 6, 2020.  Funding for this contract is included in the Enhanced Flood Program’s FY 2019-20 Adopted Budget. There is no additional impact to the General Fund.
