BACKGROUND:

On January 29, 2019, the Board of Supervisors approved Resolution No. 076380, in support of the “Flood and Sea Level Rise Resiliency Agency Proposal” (Proposal) for the new San Mateo County Flood and Sea Level Rise Resiliency District (the “District”).  The Proposal recommended revising the 1959 San Mateo Flood Control District Act) through special legislation (AB 825) to change the governance of the District from the Board of Supervisors to a seven-member board consisting of five city/town council members nominated by C/CAG and two Board members nominated by the Board of Supervisors.

 

On June 25, 2019, in anticipation of the passage of AB 825, the Board of Supervisors (the “Board”), sitting as the Governing Board of the San Mateo County Flood Control District, created a seven-member Advisory Committee to the San Mateo County Flood Control District Board (the “Advisory Committee”) comprised of two members of the Board of Supervisors and five members from city councils representing the coastal, northern, central, and southern areas of the County as well as an at-large city representative.  This Advisory Committee will ultimately serve as the new governing board of the San Mateo County Flood and Sea Level Rise Resiliency District as of January 1, 2020 (the effective date of AB 825).

 

DISCUSSION:

In connection with the potential passage of AB 825, the Advisory Committee will advise the Board of Supervisors, sitting as the Governing Board of the Flood Control District, on a variety of issues including making recommendations regarding the terms and conditions of an investment plan and various contracts.  The Advisory Committee will also undertake efforts in preparation for the District’s transition to be an independent special district such as taking steps in connection with the recruitment of an executive director/general manager.

 

In light of the Advisory Committee’s functions and duties, the County’s Conflict of Interest Code, as it pertains to the County’s Boards and Commissions, will be amended to include the committee on the list of boards, commissions, and committees for which members and certain contractors must file Form 700s.  The County’s Conflict of Interest Code for Boards and Commissions was adopted on February 26, 2008, and has been amended from time to time to reflect the addition and deletion of various County Board and Commissions in subsequent years.

 

County Counsel has reviewed and approved the attached resolutions as to form.

 

Approval of these resolutions will contribute to the Shared Vision 2025 outcome of a Collaborative Community by working on a multi-jurisdictional approach to addressing sea level rise, flooding, coastal erosion, and large-scale stormwater infrastructure improvements that benefit communities within the County.
