A)                     An amendment to the agreement with Gonsalves and Stronck Construction Company for the Wunderlich Park ADA Improvement Project, extending the term of the agreement through July 12, 2019, and increasing the amount by $175,000, to an amount not to exceed $660,400; and

 

B)                     Authorizing the Director of Public Works to execute the contract change orders up to an additional $175,000 for a new not to exceed amount of $660,400.

BACKGROUND:

The Parks Department developed plans and specs for improvements to the Wunderlich Park Carriage House. The improvements focused on providing public access in compliance with Americans with Disabilities Act (ADA) of 1990. The improvements performed at the Wunderlich Park Carriage House include a 107-square foot addition to create an ADA accessible restroom, new accessible walkways to new parking, a new accessible decked walkway to provide a secondary means of egress, and a new fire protection detection system throughout the building.

 

On May 22, 2018, your Board adopted Resolution 075907 which awarded a construction agreement to Gonsalves and Stronck Construction Company, Inc. for ADA improvements to the Wunderlich Carriage House.

 

DISCUSSION:

The project experienced a series of unforeseen conditions as construction proceeded which included dry rot and termite damage to the building’s structural elements. Gonsalves and Stronck provided extensive support to detail and correct the damages that were not in the original scope of work. 

 

The Department has negotiated with Gonsalves and Stronck a mutually acceptable contract revision order addressing the additional scope of work, modification to plans and specifications, and construction.

 

County Counsel has reviewed and approved the resolution and agreement as to form.

 

Approval of this action contributes to the Shared Vision 2025 outcome of Environmentally Conscious Community by protecting and managing these critically important habitats, as well as, maintain public access, amenities, and capital infrastructures.

 

FISCAL IMPACT:

The maximum fiscal obligation for this amendment is $175,000 for a new not to exceed amount of $660,400 for this agreement. Funding for this agreement is included in the FY 2019-20 Adopted Budget. There is no additional impact to the General Fund.
