BACKGROUND:

In the course of law enforcement activities, it is necessary to gather forensic evidence to aid in the prosecution of individuals accused of a crime.  Evidence can be gathered in many ways, including withdrawing blood from individuals involved in a motor vehicle collision who voluntarily wish to have a forensic blood specimen taken.

 

DISCUSSION:

Since June 2018, Bay Area PL Services has been providing blood specimen evidence collection services for the Sheriff’s Office Crime Lab. This evidence is used in the prosecution of individuals accused of driving under the influence and other crimes. The evidence gathering occurs at locations throughout the County as well as Stanford Medical Center and San Francisco General Hospital.

 

The average monthly usage is approximately 110 draws at a flat rate of $94.50.  The agreement mandates strict compliance with blood draw procedures and that the phlebotomists arrive at the blood draw site within 40-60 minutes of dispatch.  The agreement further mandates compliance with subpoenas and providing testimony at no additional charge.

 

The current agreement has reached its expiration and its not to exceed limit. In order to ensure continuity in services while the Sheriff’s Office completes the Request for Proposals process, the agreement must be amended to increase the amount and extend the term.

 

It is in the best interest of the County to waive the Request for Proposals requirement to ensure continuity of these critical services while the Sheriff’s Office completes the Request for Proposals process for phlebotomy services.

 

The Resolution and amendment have been reviewed and approved as to form by County Counsel.

 

This agreement contributes to the Shared Vision 2025 outcome of a Healthy Community by collecting blood specimens in a medically safe and legally appropriate manner to be used as evidence in the prosecution of individuals committing a crime.

FISCAL IMPACT:

This amendment extends the term of the Agreement to November 30, 2019 and increases the amount by $90,000 for a new total amount not to exceed of $189,000 which has been included in the Sheriff's Office FY 2019-20 Adopted Budget.

 

The cost of these services is shared between the Sheriff’s Office and the Crime Lab’s client agencies. Funds for these services are included in the Sheriff’s Office FY 2019-20 Adopted Budget.
