Adopt a resolution authorizing an agreement with the San Mateo County Bar Association for Private Defender Program services for the period of July 1, 2019 through June 30, 2021.

BACKGROUND AND DISCUSSION:
Since 1968, the County’s mandated indigent legal representation services have been provided by the Private Defender Program (PDP) through a contract with the San Mateo County Bar Association (SMCBA). The current contract with SMCBA expires June 30, 2019. The contract amount for fiscal year 2019-20 is $18,720,000 and $19,468,800 for services provided during fiscal year 2020-2021.
The County Controller has completed a follow-up audit of the PDP and found they are complying with financial reporting obligations and performance reports. The financial terms of this agreement were negotiated with the PDP and are aligned with actual costs to perform the work.
County Counsel has reviewed and approved the MOU as to form.
Approval of this agreement contributes to the Shared Vision 2025 outcome of a healthy, safe and prosperous community by ensuring that all residents of San Mateo County, regardless of their socio-economic standing, receive competent legal representation in the court of law as provided for by the United States Constitution.
PERFORMANCE MEASURE:
All financial reporting obligations and performance reports described in this agreement will be met and provided to the County as outlined.
FISCAL IMPACT:
The amount of this agreement is $18,720,000 for FY 2019-20 and $19,468,800 for FY 2020-21 for a total of $38,188,800 over two years. Funding for this agreement will be included in the Recommended Budget FY 2019-20 and FY 2020-21.
