BACKGROUND:

Launched in September 2017, DUI Court is a collaboration with the San Mateo County Superior Court, District Attorney’s Office, Private Defender Program, Behavioral Health and Recovery Services (Alcohol and Other Drugs) and the Probation Department. The purpose of DUI Court is to reduce repeat alcohol-related incidents, accidents, injuries and death.

In April 2017, the Probation Department completed a Request for Quotes (RFQ) process and selected SCRAM of California Inc. as the vendor to provide CAM services for adult probationers in the DUI Court Program.

Third time offenders are required to wear a CAM device upon release from custody, with certain second-time offenders placed on CAM as well. The SCRAM CAM ankle bracelet is attached to the offender with a durable and anti-tamper strap. It is worn 24/7 by the offender and measures alcohol content by sampling the insensible (gaseous) perspiration constantly being emitted from the body.

In recent months, there are between 40 and 60 DUI Court adult probationers per month on CAM, both county-paid and participant-paid. Probationers participate in the program for an average of 125 days. Since inception, 136 clients have been monitored, of which an average of 30% violated their monitoring at least once.  In FY 2017-18, 70% of participates had no confirmed monitoring violations.

In December 2018, the Probation Department completed a Request for Proposals (RFP) process and selected SCRAM of California Inc. as the vendor to provide the necessary electronic monitoring services (house arrest and CAM) to both adult and juvenile probationers.  A recent revision by the San Mateo County Superior Court to the Court Innovations Grant Program has allowed for the Probation Department to also utilize these funds for participants using CAM in Veterans Treatment Court and Military Diversion.

 

DISCUSSION:

Through this agreement, SCRAM of California Inc. will provide continuous alcohol monitoring (CAM) services to adult probationers in the DUI Court Program, Veterans Treatment Court, and Military Diversion. SCRAM of California Inc. will support the department via onsite and web-based trainings, installation and maintenance of equipment, file and client management, and data reporting.

County Counsel has reviewed and approved Resolution and Agreement as to form.

Approval of this Agreement contributes to the Shared Vision 2025 outcome of Safe Neighborhoods by providing offenders with alternatives to detention designed to reduce recidivism.

FISCAL IMPACT:

The term of this agreement is from July 1, 2019, through June 30, 2022. The total funding is $250,000 ($83,333 per Fiscal Year), funded by the Court Innovations Grant Program. Funds have been included in the FY 2019-20 Recommended Budget and FY 2020-21 Preliminary Recommended Budget and will be included in the FY 2021-22 Recommended Budget.
