Adopt a resolution:

 

A)                     Adopting the plans and specifications, including conformance with prevailing wage scale requirements, for the Memorial Park Wastewater Treatment Facilities Improvement Project (WWTP Project); and

 

B)                     Authorizing the President of the Board to execute an agreement with Anderson Pacific Engineering Construction, Inc., in the amount of $2,824,780 for the Memorial Park Wastewater Treatment Facilities Improvement Project (WWTP Project); and

 

C)                     Authorizing the Director of Public Works to execute subsequent change orders to grant time extensions for project completion and payment up to a maximum aggregate amount not to exceed $282,478, or approximately 10 percent of the agreement amount.

BACKGROUND:

On January 10, 2017, your Board adopted Resolution No. 074982, which authorized an agreement with Hydroscience Engineers, Inc. to provide services that included: condition assessment of existing wastewater infrastructure, field surveys, geotechnical investigation, environmental analysis and permitting (California Environmental Quality Act compliance), feasibility study, conceptual design, preparation of construction plans, specifications and cost estimates for bidding purposes and construction management and support for the Memorial Park Wastewater Treatment Facilities Improvement Project (Project).

 

On April 23, 2019, your Board adopted Resolution No. 076548, which certified the Initial Study/Mitigated Negative Declaration for the Memorial Park Wastewater Treatment Facilities Improvement Project and authorized the Director of Public Works to prepare the plans and specifications and proceed with advertising for bids for the Memorial Park Wastewater Treatment Facilities Improvement Project (WWTP Project).

 

DISCUSSION:

On Tuesday, May 21, 2019, bids were accepted for the WWTP Project and subsequently referred to Public Works for checking and recommendation. The bid of:

 

Anderson Pacific Engineering Construction, Inc.

1390 Norman Avenue,

Santa Clara, CA 95054

 

at $2,824,780 was the lowest responsible bid received for the work. The Engineer’s Estimate was $2,700,000. A summary of the bids received is attached as Exhibit “A”.

 

County Counsel has reviewed and approved the resolution as to form.

 

Approval of this action will contribute to the Shared Vision 2025 outcome of an Environmentally Conscious Community by replacing the wastewater treatment plant in order to continue to provide efficient and sustainable services to users of Memorial Park.

 

FISCAL IMPACT:

The total estimated cost for construction of the WWTP Project is $3,107,258 which includes authorization for up to $282,478 in change orders as the work is bid on a unit price basis.  The contingency is used to pay the contractor for any unforeseen conditions not anticipated in the construction agreement documents.  Funds have been allocated in the Capital Projects Budget for this Project.

 

There is no impact to the General Fund.
