BACKGROUND:

On July 21, 2015, your Board adopted Resolution No. 073960, which adopted plans and specifications including conformance with prevailing Federal wage scale requirements and authorized the Director of Public Works to call for sealed proposals for the Reconstruction of Crystal Springs Dam Bridge Project (Project) on top of the Lower Crystal Springs Dam.

 

On November 17, 2015, your Board adopted Resolution No. 074207, which authorized an agreement with Kiewit Infrastructure West Co. (Kiewit) for construction of the Project with a not-to-exceed amount of $13,090,000 and authorized the Director of Public Works to execute contract change orders in an amount not to exceed $1,190,000.

 

DISCUSSION:

Unanticipated conditions encountered during construction of the Project have led to a determination that the original “not-to-exceed” amount of the agreement will not be sufficient to appropriately compensate Kiewit for the Project based on the following factors:

 

1.)                     Additional costs associated with SFPUC’s existing facilities that required additional efforts during construction. These efforts included modifications to two of the bridge pier pockets where they interface with the dam and one of the bridge abutments due to site conditions that differed from those shown on the “as-built” drawings for the SFPUC’s Lower Crystal Springs Dam Improvements Project; additional work to address unanticipated subsurface SFPUC utility conflicts; and additional field investigations and remediation work resulting from SFPUC’s deteriorating rock wall adjacent to the reservoir. The cost of this additional work was approximately $495,243.

 

2.)                     Additional costs required for adequate coordination with PG&E relative to relocation of their electrical transmission facilities to the new bridge; and additional costs necessary to construct the north bridge embankment due to modifications to the material requirements for the embankment and special handling requirements for the serpentine soil encountered which contained naturally occurring asbestos. The cost of this additional work was approximately $765,991.

 

3.)                     Additional miscellaneous items of work require additional compensation to Kiewit.  These items include: installation of a polymer wearing surface applied to the entire bridge roadway surface and multi-use trail modifications to and construction of additional safety handrails to the SFPUC’s catwalk, landscape modifications to the tree planting plan and soil specifications as requested by the SFPUC during construction, and other miscellaneous items that were required to complete this Project. The cost of this additional work was approximately $387,685.    

 

The Department recommends that your Board consider these unanticipated conditions for this Project, and approve the recommended contract increase amount to facilitate completion of the Project. Construction issues or conflicts often arise during construction projects, which must be addressed immediately to keep the project moving forward. In some cases these issues require additional compensation. The Department worked diligently through the construction of this Project to minimize additional costs and develop solutions that were timely, effective, and financially responsible.

 

County Counsel has reviewed and approved the resolution as to form.

 

Approval of this action will contribute to the Shared Vision 2025 outcome of a Livable

Community by facilitating a bridge replacement project to provide the public with a seismically sound bridge for recreational users, bicyclists, and motorists.

 

FISCAL IMPACT:

The new not-to-exceed amount of the Kiewit construction contract is $14,153,120.27.  The recommended increase of the Project contract by $1,063,120.27 will allow for payment to the Contractor for the above-described unanticipated work. This Project is predominantly funded through the Federal Highway Bridge Replacement and Rehabilitation (HBRR) Program.  The Department applied to Caltrans, the agency that administers these funds for local projects, for additional funding in the amount of $4.5M which has recently been approved by Caltrans. The additional funding will be used for Project costs and will decrease the expenditure that would have otherwise been necessary from the Road Fund. Sufficient Road funds have been budgeted for completion of this Project as the HBRR funding is on a reimbursable basis.

 

The Department will seek reimbursement from the SFPUC for specific work requested by them during construction, which they have agreed to pay for or share in the cost of.

 

There is no impact to the General Fund.
