BACKGROUND:
On July 21, 2015, your Board adopted Resolution No. 073960, which adopted plans and specifications including conformance with prevailing Federal wage scale requirements and authorized the Director of Public Works to call for sealed proposals for the Reconstruction of Crystal Springs Dam Bridge Project (Project) on top of the Lower Crystal Springs Dam.

On November 17, 2015, your Board adopted Resolution No. 074207, which authorized an agreement with Kiewit Infrastructure West Co. (Kiewit) for construction of the Project with a not-to-exceed amount of $13,090,000 and authorized the Director of Public Works to execute contract change orders in an amount not to exceed $1,190,000.

DISCUSSION:
Unanticipated conditions encountered during construction of the Project have led to a determination that the original "not-to-exceed" amount of the agreement will not be sufficient to appropriately compensate Kiewit for the Project based on the following factors:

1.) Additional costs associated with SFPUC's existing facilities that required additional efforts during construction. These efforts included modifications to two of the bridge pier pockets where they interface with the dam and one of the bridge abutments due to site conditions that differed from those shown on the "as-built" drawings for the SFPUC's Lower Crystal Springs Dam Improv...
