BACKGROUND:

The San Francisquito Creek Joint Powers Authority (SFCJPA) was formed between the cities of Palo Alto, East Palo Alto and Menlo Park together with the San Mateo County Flood Control District (SMCFCD), and the Santa Clara Valley Water District (SCVWD) to address issues regarding the Creek after the 1998 storm event. The SFCJPA and its member agencies have been working cooperatively to implement a series of projects to provide flood protection for local residents.

 

Your Board previously approved funding from the San Francisquito Creek Flood Control Zone 2 (Zone) to support the SFCJPA’s San Francisquito Creek Flood Reduction, Ecosystem Restoration, and Recreation Project San Francisco Bay to Highway 101 (Project) for design, environmental clearance, permitting, and construction.

 

Your Board also approved Resolution No. 074539 on June 7, 2016 in connection with this Project.  This Resolution approved an Amended Construction Funding Agreement (Amended Agreement), which stipulated that construction funding from the Zone totaling $2,060,000 would be contributed to the Project.  Payments by the Zone were to be made over a three year period as follows: $800,000 (Year 1); $630,000 (Year 2); and $630,000 (Year 3).

 

DISCUSSION:

The SFCJPA has essentially completed construction of the Project. The Zone has been invoiced the amounts described in the Amended Agreement; however, the invoices have not been received on a yearly basis as described. The Zone has budgeting for the payments on a fiscal year basis with Year 1 and Year 2 payments budgeted in FY 2017-18 and 2018-19, respectively. The Zone recently received the Year 3 invoice and to enable payment, appropriate adjustments to the Zone’s budget must be made. The Department is requesting your Board’s authorization of the Appropriation Transfer Request that would allow the Zone to make the final payment for this Project.

 

County Counsel has reviewed the resolution as to form.

 

Approval of this resolution contributes to the Shared Vision 2025 outcome of a Collaborative Community by continuing to support the framework for the collaborative work of the SFCJPA member agencies by contributing to the construction of a project to solve flooding within a specific reach of the San Francisquito Creek.

 

FISCAL IMPACT:

Approval of the Appropriation Transfer Request will enable the Zone to make the Year 3 payment in the amount of $630,000 as agreed to in the Amended Agreement, but not budgeted for in the FY 2018-19 budget.

 

There is no impact to the General Fund.
