A)                     Adopt a resolution:

 

1.                     Authorizing and accepting the donation of $4,500,000 to be used to make improvements to the outdoor rifle range facility from the Thomas and Stacey Siebel Foundation; and

 

2.                     Authorizing and accepting the donation of approximately $3,000,000 in services and materials to be used to make improvements to the outdoor rifle range training facility from John Arrillaga; and

 

3.                     Authorizing the County Manager or his/her designee to execute an agreement with the Thomas and Stacey Siebel Foundation and/or John Arrillaga regarding the donation of improvements to the outdoor rifle training facility and additional site improvements, valued at approximately $7,500,000, to be installed on County property at the Coyote Point Recreational Facility; and

 

4.                     Finding that the project is categorically exempt from the California Environmental Quality Act; and

 

5.                     Finding that the project is exempt from competitive bidding requirements as donors will ensure completion of the approximately $11,000,000 project at a cost of $3,500,000 to the County and requests for competitive proposals would be futile, unavailing, and produce no public advantage as the Project could not be completed for a lower cost; and

 

6.                     Authorizing the San Mateo County Controller, upon receipt of the $4,500,000 donation from the Thomas and Stacey Siebel Foundation, to make immediate payment of $8,000,000 to Vance Brown Incorporated, consisting of $4,500,000 donated by the Thomas and Stacey Siebel Foundation and $3,500,000 provided by the County of San Mateo, for costs to be incurred in the Project; and

 

7.                     Authorizing the County Manager or his/her designee and/or the Sheriff or his/her designee to take such actions as are necessary, including the execution any necessary additional agreements, to carry out the intent of these resolutions; and

 

B)                     Approve an Appropriation Transfer Request (ATR) recognizing unanticipated revenue of $4,500,000, and increasing appropriations to Fixed Assets.

BACKGROUND:

The Coyote Point Shooting Range is located in the County’s Coyote Point Recreation Area.  First opened in 1962, the range is operated and maintained by the San Mateo County Sheriff’s Office. The range currently consists of an indoor and outdoor range, both of which are used for law enforcement firearms training, allowing Sheriff’s Deputies and officers from other municipal, state, and federal agencies to maintain their firearm qualifications. In addition, the outdoor range is open to the public three evenings each week under the auspices of the Coyote Point Rifle and Pistol Club.

 

In May 2016, the Thomas and Stacey Siebel Foundation and John Arrillaga jointly offered to plan, design, construct, install, and equip, at their expense, a state-of-the art indoor range at Coyote Point.  The Board accepted this donation and authorized payment of the donated funds to Vance Brown Incorporated, with whom John Arrillaga contracted to complete construction.   In 2017, construction of the indoor range was substantially completed at a cost of over $10,000,000, all of which was provided by the donors.  Since that time, the indoor facility has been successfully used for modern law enforcement handgun training. 

 

The outdoor range is over 55 years old and in need of substantial modernization and safety upgrades.  The Thomas and Stacey Siebel Foundation and John Arrillaga have offered to donate the costs of this approximately $11,000,000 modernization, contingent on the County contributing $3,500,000.

 

DISCUSSION:

The outdoor range, which is now more than 55 years old, is deteriorating and in need of modernization. To reduce noise generated by law enforcement’s use of the range and to increase its safety and utility for law enforcement training purposes, the Sheriff’s Office believes that it is desirable to install a modernized and accessible outdoor range and additional site improvement, to include installation of a safety baffling system on a portion of the existing range grounds and a simulation-based tactical training unit.

 

The modernized outdoor shooting range would be used for law enforcement training and the public would continue to have access as they do currently.

 

As was the case with the indoor handgun range, the Thomas and Stacey Siebel Foundation and John Arrillaga have offered to plan, design, construct, install, and donate a substantial portion of the improvements to the facility, conservatively valued at approximately $11,000,000. 

 

Pursuant to this offer, the Thomas and Stacey Siebel Foundation offered to provide $4,500,000 for the completion of the Project pursuant to terms and conditions agreed upon with the County. This offer is dependent on the County contributing $3,500,000 toward Project costs.  John Arrillaga has agreed to arrange for and oversee construction of the Project by Vance Brown Incorporated, and to provide any additional funding required for Project completion, which additional amount is currently estimated to be approximately $3,000,000.  The improvements being constructed will be subject to routine inspections by County personnel and prevailing wage requirements for public works projects.

 

The Project is exempt from competitive bidding requirements as donors will ensure completion of the approximately $11,000,000 Project at a cost of $3,500,000 to the County and requests for competing proposals would be futile, unavailing, and produce no public advantage as the Project could not be completed for a lower cost.

 

The improvements to the outdoor rifle range training facility and additional site improvements are categorically exempt from the California Environmental Quality Act (CEQA) as the Project provides for replacement of an existing facility located on the same site and with the same purpose and capacity as the existing facility and will result in a significant reduction of noise impacts.

 

Approval of the resolutions contribute to Shared Vision 2025 of a Safe Community by providing an updated facility for law enforcement to train and maintain their firearms qualifications. The public would continue to have access to the newly redesigned outdoor rifle range.

 

FISCAL IMPACT:

The adoption of this resolution will result in a one-time cost of $3,500,000 and is being funded by the Sheriff’s Office.
