B)                     Authorizing an Appropriation Transfer Request appropriating $350,000 from Office of Sustainability Departmental Reserves to Services and Supplies to fund Scope 2 of the agreement with EOA, Inc.

BACKGROUND:

The San Francisco Bay Regional Water Quality Control Board (Water Board) regulates pollutants in stormwater runoff from municipal storm drain systems throughout San Mateo, Santa Clara, Alameda, and Contra Costa Counties through the Municipal Regional Permit (MRP). The current MRP requires the County to develop and implement a Green Infrastructure Plan (GI Plan) with the intent of gradually shifting the County areas and facilities from traditional “gray” storm drain infrastructure to “green” infrastructure which captures, stores, and treats stormwater using specially-designed landscape systems.

 

On April 25, 2017, your Board adopted Resolution No. 075143 approving the County’s GI Workplan for developing and submitting the GI Plan to the Water Board by September 30, 2019. The development of the GI Plan will require the collaboration of multiple departments coordinated by the Office of Sustainability, including: Department of Public Works, Planning and Building Department, the County Manager’s Real Property Division, Project Development Unit, and the Parks Department. The County also intends to work collaboratively with cities on regional, multi-benefit projects.

 

 

DISCUSSION:

On May 24, 2018 the County Office of Sustainability released an RFP to identify a qualified consultant or consultant team to develop a GI Plan for unincorporated county.

The solicitation process closed on June 22, 2018. The Office of Sustainability received six responses to the RFP. The review committee consisted of eight individuals from the Office of Sustainability, Department of Public Works, Planning and Building Department, City/County Association of Governments (C/CAG), and the Parks Department. Four applicants were selected for an interview with the review committee on July 17 and 18, 2018. The review committee met on July 19, 2018 to evaluate and rank all the proposals. EOA, Inc. (EOA) was selected as the preferred consultant with Lotus Water, Paradigm Environmental, David J. Powers & Associates Inc., and SCI Consulting Group identified as part of the consulting team. This determination was made based on many factors, including: quality of proposals, familiarity with the MRP, experience with GI Plans of similar scope, and cost-effectiveness of proposals. A Notice of Intent to award the contract to EOA was released and contract negotiations began on August 1, 2018.

 

The required elements of the GI Plan development that EOA will complete are:

                     Update policies, ordinances, and legal mechanisms to integrate GI requirements;

                     Prioritize and map GI projects;

                     Create a workplan for prioritized projects;

                     Develop GI guidelines and standards; and

                     Complete and adopt the GI plan.

 

This resolution contains the County’s standard provisions allowing amendment(s) of the County’s fiscal obligations by the Director of the Office of Sustainability, up to a maximum of $25,000 (in aggregate) without Board approval.

 

County Counsel has reviewed and approved the Agreement and Resolution as to form.

 

SHARED VISION 2025:

Approval of this resolution contributes to the Shared Vision 2025 outcome of an Environmentally Conscious Community through the improvement of water quality, reduction of pollutants, and protection of water resources. Approval of this resolution also contributes to the Shared Vision 2025 outcome of Collaborative Community by identifying regional collaborative projects to reduce pollutants entering our common waterways in a cost-effective manner.

 

FISCAL IMPACT:

The term of the agreement is October 2, 2018 to December 31, 2019 for a not to exceed amount of $623,817. The agreement is being funded by the Office of Sustainability and the Planning and Building Department.  An amount not to exceed $257,529 will be funded by the Planning and Building Department and has been included in the Department’s FY 2018-19 Adopted Budget. An amount not to exceed $366,288 will be funded by the Office of Sustainability. Approval of the Appropriation Transfer Request will appropriate funds in the amount of $350,000 from the Office of Sustainability Departmental Reserves to Services and Supplies with the balance of $16,288 included in the Office’s FY 2018-19 Adopted Budget.

 

The development of the County’s Green Infrastructure Plan is one step of many necessary to comply with MRP requirements and transition from grey to green infrastructure. The additional costs for MRP compliance, including design, construction and maintenance of green infrastructure projects and implementation of other MRP requirements have not been included in this item.
