BACKGROUND:

The California Department of Health Care Services (DHCS), Title 9, requires all Driving Under the Influence (DUI) programs to pay an administrative fee to the county in which they are operating. In San Mateo County, Behavioral Health and Recovery Services (BHRS) receives the administrative fee collected from MHN Government Services, LLC for costs associated with monitoring and overseeing alcohol and drug programs. The rates for these administrative fees assessed by the County are approved by DHCS. It is the responsibility of the County to ensure DUI programs are in compliance with the regulations and requirements under Title 9 and Division 10.5 of the Health and Safety Code, and the programmatic and fiscal integrity of the DUI programs.

 

DISCUSSION:

This revenue agreement provides First Offender Program and Multiple Offender Program DUI services (e.g. substance abuse education and counseling) to San Mateo County residents. The objectives of the DUI services are to: enable participants to comply with court ordered participation, increase safety on the highways, create self-awareness of alcohol and other drug abuse issues, and ultimately prevent future DUI episodes among participants.

 

The agreement is late due to a delay by the contractor returning the signed agreement.

 

The agreement and resolution have been reviewed and approved by County Counsel as to form.

 

Approval of this agreement contributes to the Shared Vision 2025 outcome of a Healthy Community by providing individuals and families with prevention and treatment services to support recovery, which in turn contributes to the health and safety of communities throughout San Mateo County.   DUI programs have been an effective form of treatment and intervention to reduce alcohol-related driving and crashes. Successful completion of the program occurs when a program participant has completed all DUI program requirements in accordance with California Code of Regulations, Title IX, Division 4, Section 9851.  These services are court mandated and often accompany license revocation.  It is anticipated that 85% of clients who receive services will successfully complete the DUI program.

FISCAL IMPACT:

The term of this revenue agreement is July 1, 2017 through June 30, 2020. These administrative fees, collected on a monthly basis, are anticipated to be $243,000 over the three year period. These fees cover all administrative costs associated with this program, with no Net County Cost. The anticipated amount for FY 2017-18 is $81,000 and is included in the BHRS FY 2017-18 Adopted Recommended Budget. Similar arrangements will be made for subsequent years.
