BACKGROUND:

Measure A is the ten-year half-cent general sales tax approved by San Mateo County voters in November 2012. On November 8, 2016 the voters of San Mateo County approved Measure K, which extends Measure A for 20 years. The Measure requires the appointment of “a committee to perform an annual audit of the general fund revenues generated by [the] Retail Transactions (Sales) and Use Tax.” On July 9, 2013, the Board created the “Measure A Oversight Committee” and appointed its first ten members to a two-year term. The Board also established that the Oversight Committee members may serve no more than two consecutive terms. On February 14, 2017, the Board approved a name change to the “Measure K Oversight Committee” and extended the maximum number of terms for Oversight Committee members from two to three consecutive terms.

 

DISCUSSION:

The first Oversight Committee members appointed by the Board are scheduled to complete their third consecutive two-year terms on or about June 30, 2019. The Oversight Committee has determined that in light of the nature of the work performed by the Committee members, the need for continuity on the Oversight Committee, and the increased duration of the Measure (now in place for a total of thirty years, rather than ten years), it would be beneficial for Committee members to be authorized to four-year terms, rather than two-year terms, if such appointments are approved by the Board in its sole discretion. This change, if approved, would be consistent with the standard term length (four years) and maximum number of consecutive terms (three terms) typically in place for County boards and commissions. For Committee members serving an active term as of January 1, 2019, staff recommends imposing a total maximum consecutive service of twelve years, regardless of the number of terms served, to achieve the objectives of continuity and efficiency.

 

The Oversight Committee has further recommended that the Board stagger the terms for one-half of the members such that the terms of the Oversight Committee members do not all expire in the same year. Staff will consult with Board members during the appointment or re-appointment process to provide for staggered term end dates.

 

County Counsel has reviewed the resolution as to form.

 

FISCAL IMPACT:

There is no fiscal impact in adopting the resolution.
