Adopt a resolution authorizing:
A) Waiving the Request for Proposals Process; and
B) The County of San Mateo’s Chief Probation Officer to execute and Amendment to Resolution # 076073 for the agreements with the California Department of Corrections and Rehabilitation, Division of Juvenile Justice Facilities to provide diagnostic studies, treatment services and temporary detention services for case referrals from San Mateo County Superior Court, for a term through June 30, 2021, in an amount not to exceed $211,404; and
C) Providing emergency housing for case referrals from San Mateo County Superior Court, term is upon Board approval through June 30, 2021, in an amount not to exceed $109,702.56 in an aggregate amount not to exceed $321,106.56.

BACKGROUND:
Pursuant to the California Welfare and Institutions Code Section 1752.1, a contractual agreement may be entered into between the Director of the State of California Department of Corrections and Rehabilitation, with the approval of the Director of Finance, with any county of the State of California upon request of the Board of Supervisors for diagnosis and treatment services as well as temporary detention for selected cases of persons eligible for commitment with CDCR/DJJ, in connection with the operation of the Juvenile Court.
Pursuant to proposed agreements, CDCR/DJJ will provide the Court with a diagnostic evaluation of the juvenile client. This additional information will assist Juvenile Court judges in making a decision if it is appropriate to refer a juvenile client to DJJ for treatment and temporary detention.
An Amendment of Resolution #: 076073 is being requested, as due to clerical error the funding amounts previously listed on the Memo and Resolution were incorrectly stated, however the amounts listed on the Agreements were and are correct.
DISCUSSION:
The first agreement authorizes the CDCR/DJJ to provide diagnostic studies, treatment services and temporary detention for case referrals from Juvenile Court. Although, diagnostic services are rarely used by the Court, the adoption of this agreement is necessary should these services be required at some time in the next two years. The second agreement is for emergency housing from case referrals from the juvenile and criminal courts, which will provide food, clothing, hygiene, recreation and other daily provisions consistent with the CDCR/DJJ standards, as well as routine medical, dental or mental health treatment and routine periodic medical examinations for the referred juveniles. The agreement does not include the provisions of ancillary or unnecessary medical or dental services, or related transportation costs.
These agreements set forth a mechanism that would allow CDCR/DJJ to be reimbursed by the Probation Department for services rendered for each juvenile referral. Pursuant to the proposed agreements, the Probation Department will reimburse CDCR/DJJ at a rate of two-hundred and twenty-three ($223.00) dollars per day/per juvenile case for up to 90 days for diagnostic studies, treatment services and temporary detention services with the total amount not to exceed $211,404.00. Also, the Department will reimburse CDCR/DJJ at a rate of one-hundred fifteen dollars and seventy two cents ($115.72) per day/juvenile for emergency housing and related services with the total amount not to exceed $109,702.56.
The Probation Department requests the Amended Resolution # 076073 be adopted.
The Probation Department requests a waiver of the Request for Proposal process requirement as the CDCR/DJJ is the lead public agency in the State that has the capacity to provide youth offenders the needed diagnostic studies, treatment services and temporary detention, as well as emergency housing services.
The Probation Department requests that the Chief Probation Officer or his designee be granted authorization to execute contract amendments that modify the County’s maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.
The term of the agreement is upon Board approval through June 30, 2021.
The Agreements and Amended Resolution have been reviewed and approved by County Counsel.
Approval of this Agreement contributes to the Shared Vision 2025 outcome of Safe Neighborhoods by helping youth reduce destructive and criminal behavior.

FISCAL IMPACT:
The term of each agreement is upon Board approval through June 30, 2021. The total amount of both agreements is $321,106.56. Funds for these services have been included in the FY 2018-19 Adopted Budget and will be included in the FY 2019-20 and FY 2020-21 Future Budgets.
