BACKGROUND:

John C. Beiers was appointed County Counsel by this Board on March 20, 2011. By

Resolution 072058, this Board entered into a four year contract with John C. Beiers for

services as County Counsel effective July 10, 2012.  By amendment to the Agreement, the term of the Agreement was previously extended once.   

 

DISCUSSION:

Counties throughout the state, pursuant to Government Code section 27641, customarily enter into contracts with their County Counsel for four year terms. Mr. Beiers has provided excellent service to the County and to this Board. Contracting with Mr. Beiers for an additional four year term will provide continuity to his position, which in turn provides stable legal representation for the County.

 

The Amendment to the Agreement provides that Mr. Beiers will be employed for an

additional four year term as County Counsel commencing on today’s date. At the end of the additional four years, he may continue service on terms determined by the parties at that time. The Amendment to the Agreement serves to memorialize and continue without change the salary, compensation and benefits that Mr. Beiers currently receives as a Department Head. 

 

The Amendment to the Agreement also makes certain clarifying changes pertaining to vacation benefits and compliance with Government Code Section 53243 (Abuse of Office.

 

FISCAL IMPACT:

This action will have no new fiscal impact.
