BACKGROUND:

Electronic monitoring has been proven to be an effective alternative to detention for individuals in the criminal justice system. In 2012, the Probation Department worked with the Sheriff’s Office’s Alternative Sentencing Bureau and conducted tests of existing electronic monitoring products in the market and BI Inc.’s services was determined to be far superior when compared to other providers.  In addition, the Probation Department conducted its own statewide survey and BI, Inc. was the top choice for providing the necessary electronic monitoring services to probationers.  Since then, the Probation Department has been using BI, Inc. to provide electronic monitoring services to juveniles in the Electronic Monitoring Program (EMP) as well as those in Home Supervision. Additionally, BI Inc. provides electronic monitoring to adult probationers enrolled in the Bridges Program. 

 

For the past six years, BI Inc. has been providing three kinds of monitoring: (1) Radio Frequency Monitoring (RFM) of the client’s home, (2) mobile breath alcohol monitoring system and (3) Transdermal Alcohol Detector. BI Inc. also provides the following services to the Probation Department:

 

1.                     On-site training for Probation Department staff;

2.                     All access training via web conferencing;

3.                     Monitoring Services;

4.                     Equipment and monitoring technical support;

5.                     Equipment rental maintenance

 

In FY 2016-17 there were 172 unique juvenile probationers and 26 unique adult probationers in the Bridges program that utilized the electronic monitoring devices through BI Inc.

 

DISCUSSION:

In 2015, the Probation Department executed a new contract with BI Inc. for a term of July 1, 2015, through June 30, 2017, in an amount not to exceed $90,000 for services to both juvenile and adult probationers. A first amendment to the contract was completed in May 2017, extending the contract term through June 30, 2018, with no changes to the total contract amount. This second amendment will allow the Probation Department to continue providing valuable electronic monitoring services to both juvenile and adult offenders as an alternative to detention, extending the term of the agreement through January 31, 2019, and increase the funding by $102,083.25 to an amount not to exceed $192,083.25 for the duration of the contract to allow for the continued use of electronic monitoring devices for both juvenile and adult probationers. By extending this contract through January 31, 2019 the total term of this contract will be three years, the max term based on policy and procedure. The Probation Department is creating a Request for Proposal (RFP) for services to begin February 1, 2019. It is the goal of the Probation Department to release the RFP later this fall.

 

County Counsel has reviewed and approved resolution and amendment as to form.

 

Approval of this agreement contributes to the Shared Vision 2025 outcome of Safe Neighborhoods by providing adult offenders with alternatives to detention designed to reduce recidivism.

FISCAL IMPACT:

The term of this agreement is extended through January 31, 2019. The total increase in funding is $102,083.25, raising the current contract to an amount not to exceed $192,083.25 (113.5% percent increase). This increase is related an increase in the number of youth that have been referred to EMP in lieu of detention. San Mateo Probation is responsible for one-hundred percent (100%) of any fees associated with the EMP service. Funds have been included in the FY 2017-18 and FY 2018-19 Adopted Budgets.
