BACKGROUND:
The Health System has a number of contracts for services that will expire on or before June 30, 2018 and the renegotiation of these contracts is pending completion. At the June 19, 2018 meeting of this Board of Supervisors, the Board adopted Resolution No. 075948, which authorizes the County Controller to continue making payments up to a certain amount on some Health System contacts which will be submitted as new agreements by the end of September 2018.
However, owing to clerical error, the list of contracts that was submitted with Resolution Number 075948 included incorrectly low maximum amounts payable for some of the contracts. Because many of the agencies impacted by this error are in immediate need of County payments to sustain operations, the Health System requests that the Board adopt a revised resolution to remedy this error.
These contracts, with the corrected maximum amount authorized to be paid, are listed in the Exhibit to this revised Resolution and they will be submitted as new agreements or for extensions by the end of September 2018.
DISCUSSION:
To ensure continued provision of the contracted services during the interim period between July 1, 2018 and September 30, 2018, staff requests that the Board of Supervisors authorize the Controller to continue to make payments under these contracts listed on the Exhibit to the revised Resolution at the existing rates through September 30, 2018. This Resolution allows payments to contractors who provide necessary services in a timely fashion and will allow the Health System the time needed to complete negotiations for new contracts. For all agreements subject to this Resolution, all the terms and conditions of each agreement, including with respect to payment rates, shall remain in effect during the term of the continuing resolution.
The contracts included in the Resolution from Behavioral Health and Recovery Services typically include a monthly advanced payment for the fixed flat rate of the portion of the provider’s contract that is paid out in one-twelfth increments of the annual rate. Inclusion of such contracts on the Exhibit to the Resolution authorizes the Controller to make these regular monthly payments beyond June 30, 2018. We expect to bring most of these contracts to your Board in July.
The contracts for Public Health Policy and Planning provide continued funding of programs for the STD/AIDS programs funded through the City and County of San Francisco. The City and County of San Francisco has not provided final confirmation of the amount of funding they will receive to pass through the Public Health Programs.
The resolution has been reviewed and approved by County Counsel as to form.
Approval of this resolution contributes to the Shared Vision 2025 outcome of a Healthy Community by enabling the Health System to continue to provide a continuity of services to the community until final negotiations can be completed.
FISCAL IMPACT:
Funds for the annual costs of these contracts have been included in the Health System FY 2018-19 Recommended Budget.
