A)                     The transfer of the real property located at 1220 Bayshore Highway in the City of Burlingame, also known as San Mateo County Assessor’s Parcel Numbers 026-142-020 and 026-142-030, to the San Mateo County Transportation Authority; and

 

B)                     The County Manager, or his designee, to accept and execute on behalf of the County any and all notices, options, consents, approvals, deeds, and documents in connection with the conveyance.

BACKGROUND:

On December 11, 2012, as authorized by San Mateo County Resolution No. 072287, the County and the San Mateo County Transportation Authority (“SMCTA”) entered into a Cooperative Agreement for Right of Way Services (“Agreement”).  Pursuant to the terms of the Agreement, County was to assist SMCTA with the acquisition of any real property necessary to effectuate the construction of the Broadway Interchange Project (“Project”).  County agreed to assist SMCTA because SMCTA does not have legal authority to condemn property.   

 

Based on the permitted design of the Project, ownership of the real property located at 1220 Bayshore Highway in the City of Burlingame, also known as San Mateo County Assessor’s Parcel Numbers 026-142-020 and 026-142-030 (“Property”) was required.  SMCTA hired outside counsel to litigate the proceedings and compensated the County for the minimal staff time spent supporting the condemnation proceedings.  On August 13, 2015, the Final Order of Condemnation was recorded and County acquired title to the Property. The Project has since been constructed and completed.

 

DISCUSSION:

The SMCTA has requested that the County transfer title to the Property.  Pursuant to Section 2(e) of the Agreement, County is obligated to transfer title to the Property to SMCTA in the form in which it was acquired.  A legal description for the Property can be found on Exhibit A attached.

 

County Counsel has approved the resolution as to form. 

 

Approval of this action contributes to the Shared Vision 2025 outcome of a Collaborative Community by supporting the SMCTA in implementing vehicular mobility enhancement projects within the County of San Mateo.

 

FISCAL IMPACT:

There is no Net County Cost associated with this item.
