Adopt a resolution authorizing:

 

A)                     The President of the Board of Supervisors to execute an agreement with The Gordian Group, Inc. for the maintenance and support of eGordian, the Job Order Contracting (JOC) System and JOC Program, from August 8, 2017 through August 7, 2020, in an amount not-to-exceed $500,000; and

 

B)                     The Director of Public Works, and/or his designee, to execute individual and/or separate job orders and incur fees under this agreement in an amount, in aggregate, not-to-exceed $500,000.

BACKGROUND:

Job Order Contracting (JOC) is a task-based method of project delivery whereby contractors (i.e. general, mechanical, electrical, utilities or road contractors) agree to perform a myriad of construction tasks for a set fee.  JOC has been utilized extensively at the Federal, State, and local government levels throughout the country for over 23 years.

 

On July 26, 2011, your Board approved Resolution 071562 which authorized the execution of an agreement with The Gordian Group to develop, implement and support the JOC System and Program for the Department of Public Works.

 

The Department of Public Works has made increasing and substantial use of this system and program since its implementation.  Over $40 million in projects have been completed under the program in the past nine years.

 

DISCUSSION:

The Department is currently using The Gordian Group’s proprietary software system, eGordian (System), for ten JOC’s, (four for General Construction, three for Mechanical Works and three for Engineering).  The System has been customized to fit the County’s JOC needs.  The current JOC contracts will expire in January 2018 and March 2018.

 

The Department is recommending the option of selecting the JOC Complete Solution and JOC Complete Solution Plus level of services on a project-by-project basis under the new contract. These additional Complete and Plus level services include Job Order development, estimating, and construction management services, which the County could utilize as needed to facilitate completion of JOC projects should the need arise due to staff shortages, vacancies, temporary excess workload, or new staffing directives.

 

The Department is also recommending that your Board authorize the Director of Public Works or his/her designee to execute subsequent amendments which do not to exceed an aggregate of $25,000.

 

The Department is requesting a waiver of the Request for Proposals process because The Gordian Group remains the sole source provider of products and services for the JOC program. A listing of agencies which have recently conducted RFP’s and awarded The Gordian Group sole source contracts, is attached for reference.  The dollar value of this agreement is consistent with those agreements set forth as a result of the aforementioned RFP’s and sole source justification.

 

The Gordian Group, Inc. has assured compliance with the County's Contractor Employee Jury Service Ordinance, as well as, all other provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits.

 

County Counsel has reviewed and approved the resolution and agreement as to form.

 

Approval of this action contributes to the Shared Vision 2025 outcome of Collaborative Community by reducing the cost and time required to execute major maintenance and renovation projects throughout all County facilities.

 

FISCAL IMPACT:

The term of this agreement is August 8, 2017 through August 7, 2020.  The not to exceed amount is $500,000.  Funding has been included in the Department’s Fiscal Year 2017-18 Approved Recommended Budget and Fiscal Year 2018-19 Preliminarily Recommended Budget. 

 

There is no additional impact to the General Fund.
