Adopt a resolution authorizing the Director of Public Works, or his designee, to make administrative changes to executed Job Order Contract (JOC) agreements.

BACKGROUND:

Public Contract Code Section 20128.5 authorizes a Board of Supervisors to award individual annual JOCs for repair, remodeling, or other repetitive work to facilitate the completion of projects. On January 24, 2017, the Board of Supervisors awarded and executed seven JOCs (four for General Construction and three for Mechanical Works).

 

On April 28, 2017, the Department of Public Works received notice that one of the current JOC contractors, Therma Corporation, was in the process of changing ownership and would be operating under a new entity, Therma LLC, effective June 19, 2017. The business has advised the County it will continue to operate under existing management. The performance of this contractor, to date, has been invaluable in ensuring quality construction, repair and renovation of facilities. As such, the Department would like to continue receiving services under the new entity.

 

DISCUSSION:

To mitigate and streamline similar occurrences in the future, the Department is requesting your Board’s approval to authorize the Director of Public Works, or his designee, to make any necessary administrative changes to the existing JOC agreements, including amendments reflecting changes in the corporate structure of the contractor. Any increase above the amount or term of the originally authorized Agreement(s) would be submitted to the Board for approval.

 

County Counsel has reviewed and approved the resolution and amendment as to form.

 

Approval of this action contributes to the Shared Vision 2025 outcome of a Collaborative Community by approaching construction and renovation projects in County facilities with fiscal accountability and concern.   

 

FISCAL IMPACT:

There is no fiscal impact to any agreements.

 

There is no impact to the General Fund.
