BACKGROUND:
On October 19, 2021, this Board adopted Resolution No. 078497(d), which authorized an on-call agreement with AECOM Technical Services, Inc. (AECOM) to provide engineering design and construction management services in an amount not-to-exceed $1,500,000.

On October 3, 2023, this Board adopted Resolution No. 079983, which authorized Amendment No. 1 to the on-call agreement with AECOM to increase the not-to-exceed amount by $700,000 to $2,200,000.

On March 12, 2024, this Board adopted Resolution No. 080234, which authorized Amendment No. 2 to the on-call agreement with AECOM to increase the not-to-exceed amount by $640,000 to $2,840,000.

On October 31, 2024, as authorized by Resolution No. 080234, the Director of Public Works executed Amendment No. 3 to the on-call agreement with AECOM, increasing the not-to-exceed amount by $25,000 to $2,865,000, and extended the term through October 18, 2026.

DISCUSSION:
AECOM has provided construction management services for the Middlefield Road Improvement Project (Project), which has spanned three years, and has incurred costs that have exceeded the current not-to-exceed amount in the agreement in an effort to complete the work and close the construction phase of the Project.
