BACKGROUND:
On November 14, 2023, this Board adopted Resolution No. 080039(i), which authorized an on-call agreement with Lotus Water to provide flood control, drainage system study, environmental protection, stormwater management, and design services in an amount not-to-exceed $1,000,000 and for a period of three (3) years through November 13, 2026.

DISCUSSION:
Amendment No. 1 increases the not-to-exceed amount of the Agreement to $1,500,000. Lotus Water has performed on-call services for the Entrada Way Slip-out Project (Project), as well as other various County projects through Task Orders issued by the Department of Public Works (Department). Additional outreach efforts, complex design and permitting issues related to the Project require additional efforts from Lotus Water to analyze and complete the final design. The Department recommends Amendment No. 1 be executed to provide continued design services for the Project and other various County on-call projects.

The Department has coordinated with Lotus Water regarding the requested increase and time extension and is recommending that Amendment No.1 be executed to allow for continued needed services. Amendment No. 1 increases the not-to-exceed amount of the Agreement by $500,000 and extends the term through November 13, 2028.
