BACKGROUND:
In 1998, pursuant to the Lockyer-Isenberg Trial Court Funding Act of 1997, the State assumed responsibility for funding "Trial Court Operations", as defined in Government Code section 77003 and California Rules of Court, Rule 10.810. Since that time, the Court and the County have entered into MOUs to define the services provided by each agency and the related terms and conditions.

DISCUSSION:
On June 17, 2014, the Board of Supervisors, as fiscal agent for local AB 109 funds, approved allocation of an amount not-to-exceed $630,000 over a three year period to reimburse the Court for the salary and benefits of one Court Commissioner position for fiscal years 2014-15 through 2016-17. The purpose of the allocation was to enhance the ability of the Court to handle its Realignment cases, which has had a significant impact on the Court's overall caseload, while at the same time absorbing significant cuts in trial court funding. The current MOU between the Court and the County, which was entered into on December 1, 2015, memorialized that agreement.
