A) Adopt a resolution accepting a grant in the amount of $24,148 from the California Department of Justice (DOJ) to audit untested sexual assault evidence kits; and
B) Approve an Appropriation Transfer Request in the amount of $24,148, establishing a budget appropriation and revenue for the work conducted.

BACKGROUND:
In September 2018, Governor Jerry Brown signed AB 3118, which amended Penal Code section 680.4 and requires every law enforcement agency, medical facility, crime laboratory, and other specified facilities, to conduct an audit of all untested victim sexual assault evidence kits in their possession and report to the DOJ on the status of said kits no later than July 1, 2019. As a result, the DOJ created and administers the Untested Sexual Assault Evidence Grant Program (USAEG) which provides funding for city and county agencies to conduct the audits required.
DISCUSSION:
In order to comply with AB 3118, the San Mateo County Sheriff's Office Property Bureau drafted and submitted an application requesting funding to audit all untested sexual assault evidence kits. Subsequently, the California Department of Justice accepted the application and awarded the San Mateo County Sheriff's Office with $24,148 to be utilized for this program. This grant funding will support staff costs associated with efficiently and accurately reviewing all untested victim sexual assault evidence kits.
The resolution has been reviewed and approved as to form by County Counsel.
Acceptance of this grant contributes to the Shared Vision 2025 outcome of a Healthy Community by ensuring compliance with state legislation that is intended to protect sexual assault victims.
