C)                     The Chief of San Mateo County Health, or designee(s) to execute the Participation Agreement and any amendment to the Participation Agreement with California Mental Health Services Authority (CalMHSA) to administer the CCE grant, for the term of June 1, 2024, through March 31, 2027, in an amount not to exceed $4,296,863.

BACKGROUND:

California has a shortage of adult and senior care facilities that accept individuals receiving or applying for Supplemental Security Income/State Supplementary Payment (SSI/SSP) or Cash Assistance Program for Immigrants (CAPI). California has also seen a decline in the number of SSI/SSP recipients residing in adult and senior care facilities. The State’s Community Care Expansion (CCE) program was established by Assembly Bill 172 (Chapter 696, Statutes of 2021) to fund capital projects and promote the sustainability of residential adult and senior care facilities and to address historic gaps in the long-term care continuum. Statewide, the CCE program provides a total of $805 million in funding for acquisition, construction, and rehabilitation to preserve and expand adult and senior care facilities that serve SSI/SSP and CAPI applicants and recipients, including those who are experiencing or at risk of homelessness.

 

A total of $195 million Statewide is reserved for the CCE Preservation Funds, which are intended to immediately preserve and avoid the closure of licensed residential adult and senior care facilities serving qualified residents, defined as applicants or recipients of SSI/SSP or CAPI, including the prioritized population of qualified residents who are experiencing or at risk of homelessness.

 

DISCUSSION:

Behavioral Health & Recovery Services (BHRS) submitted applications to the State’s Behavioral Health Continuum Infrastructure Program, which, jointly with the CCE Program, sought projects that address behavioral health capital needs. BHRS’ application for the CCE Preservation Funds was awarded $4,065,315, with the funds allocated to the San Mateo County Department of Housing to administer. The Department of Housing agreed to accept the funds if BHRS would run the program. BHRS completed two RFP processes for administration of the program services, with no successful results. As a result, CalMHSA agreed to administer the program for a 15% administrative fee, which is allowed by the funding source, plus a BHRS-contributed 10% match for the capital project portion of the program in the amount of $231,548 drawn from the Mental Health Services Act funding. This brings the total amount of the contract to $4,296,863.

 

Formed in 2009, CalMHSA is a public entity created under authority of Joint Powers of Authority (JPA), in which the County is a member, that provides administrative and fiscal services.

 

The CDSS Agreement, First Amendment to the Agreement, and Participation Agreement are coming to this Board late due to extended negotiations with CalMHSA, to partner with the County for the administration of the CCE Preservation Funds.

 

The resolution contains the County’s standard provision allowing amendment of the County’s fiscal obligations by a maximum of $25,000 (in aggregate).

 

The CDSS Agreement, First Amendment to the Agreement, Participation Agreement, and resolution have been reviewed and approved by the County Attorney as to form.

 

It is anticipated that 90% of the applications received by CalMHSA will be awarded funding

EQUITY IMPACT:

This funding helps preserve and support in-county licensed residential adult and senior care facilities that are serving behavioral health clients in multiple locations in the county. This funding will positively impact Medi-Cal beneficiaries because it will allow beneficiaries to remain in their communities.  Finally, this specifically targets low-income individuals of diverse ethnic backgrounds, including those that may be at risk of homelessness.

 

FISCAL IMPACT:

The term of the Participation Agreement with CalMHSA is June 1, 2024, through March 31, 2027. The amount of the agreement is not to exceed $4,296,863. Of the agreement amount, $4,065,315 will be funded by the grant award and $231,548 will be funded by the Mental Health Service Act. 15% of the grant award can be used to administer the grant, which is the cost of CalMHSA, in the amount of $609,797 which is funded by the grant award.
